【摘要】：在互聯(lián)網(wǎng)普及率穩(wěn)步增長的趨勢下,互聯(lián)網(wǎng)的應(yīng)用變得更加寬泛。以網(wǎng)站為平臺的各種經(jīng)營行成為當(dāng)前我們主要的消費(fèi)方式之一。例如淘寶網(wǎng)。由于我國人口基數(shù)較大,市場經(jīng)濟(jì)飛速發(fā)展,加上各種互聯(lián)網(wǎng)技術(shù)普及較快,使得我國擁有龐大的互聯(lián)網(wǎng)消費(fèi)群體。據(jù)有關(guān)媒體報(bào)道,2016年雙十一全球購物節(jié)24小時(shí)線上交易總額為178億美元。這組龐大的數(shù)字背后依托的是一個(gè)網(wǎng)站,如果網(wǎng)站不合法規(guī)、沒有合理的糾紛解決機(jī)制和嚴(yán)格的監(jiān)管體系,那么侵害的就是這組數(shù)字背后龐大的消費(fèi)群體。從政府的角度出發(fā),我們需要以行政許可的方式,將那些違規(guī)的網(wǎng)站扼殺在搖籃里,通過監(jiān)管營造良好的網(wǎng)絡(luò)交易環(huán)境,促進(jìn)經(jīng)濟(jì)和互聯(lián)網(wǎng)絡(luò)的健康發(fā)展。對于互聯(lián)網(wǎng)站的各方面研究數(shù)不勝數(shù),但是以行政許可的角度論述經(jīng)營性網(wǎng)站的研究卻是鳳毛麟角,加之網(wǎng)站發(fā)展迅速,變化之快,數(shù)據(jù)分析龐大,使得本文研究困難。但是我認(rèn)為,我國互聯(lián)網(wǎng)的發(fā)展已經(jīng)有了一定的規(guī)模,跟網(wǎng)站相關(guān)的民生問題急需解決,加強(qiáng)網(wǎng)站規(guī)范、統(tǒng)一、制度化管理是我國互聯(lián)網(wǎng)發(fā)展的必然要求,也是國際大環(huán)境的趨勢所在。本文就圍繞我國經(jīng)營性網(wǎng)站行政許可中出現(xiàn)的問題進(jìn)行分析,并且針對這些問題提出法律建議。立法方面,由于網(wǎng)站類型較多,缺乏關(guān)于網(wǎng)站許可的統(tǒng)一立法,并且立法位階較低,立法較社會的發(fā)展相對落后,忽略保障公民權(quán)益的指導(dǎo)思想;在許可審批程序方面,各實(shí)施機(jī)關(guān)缺乏合作精神,權(quán)限、職責(zé)劃分不明確,出現(xiàn)管理權(quán)限之爭;對網(wǎng)站許可的處理期限較長,申請程序繁雜,缺乏合理的評估機(jī)制和透明的審批程序;在監(jiān)管中,沒有形成統(tǒng)一的監(jiān)督管理體系,監(jiān)管手段也已經(jīng)跟不上網(wǎng)站的發(fā)展速度。出現(xiàn)問題,是任何一個(gè)國家在法律制度方面都會面臨的,與一個(gè)國家的政治、經(jīng)濟(jì)、歷史文化息息相關(guān)。如何正視問題并且根據(jù)自身發(fā)展情況及時(shí)解決問題才是最重要的。針對上述問題,我們需要立足于我國的實(shí)際情況,統(tǒng)一立法指導(dǎo)思想,加快經(jīng)營性網(wǎng)站的行政許可立法;加快建立統(tǒng)一的監(jiān)督管理體系。
[Abstract]:The Internet penetration rate in the steady growth trend, the application of the Internet become more popular. The website as a platform for various business lines has become one of the main ways of consumption at present. For example taobao.com. Due to China's large population base, the rapid development of market economy, plus a variety of Internet technology spread rapidly, making China's huge the Internet consumer groups. According to media reports, in 2016 eleven of the global total double Shopping Festival 24 hours online trading for $17 billion 800 million. The group behind the numbers is relying on a website, if the site sub regulations, there is no reasonable dispute resolution mechanism and strict supervision system, it is against this group of figures behind the huge consumer groups. From the perspective of the government, we need to administrative license, illegal websites that strangled in the cradle, through regulation to create a good The trade of the network environment, and promote the healthy development of the economy and the Internet. For the study of all aspects of the Internet to beyond count, but the administrative licensing aspects of business website research is very rare, coupled with the rapid development of the website, fast changing, massive data analysis, which makes the research difficult. But I think that the development of China's Internet has a certain scale, urgent livelihood issues related to the web site address, strengthen the standardized, unified, systematic management is the inevitable requirement of the development of the Internet in China, the international environment is the trend. This article carries on the analysis on the administrative permission website appeared in our country, and put forward the legal suggestions to solve these problems. The legislation, because there are many types of sites, the lack of uniform legislation on site license, and the low rank of legislation, the legislation is the development of the society. The exhibition is relatively backward, ignoring the guiding ideology of guaranteeing the rights of citizens; in approval procedures, the implementation organ of authority, lack of the spirit of cooperation, not clear division of responsibilities, management authority for a longer treatment period; on site license, application procedures are complicated, the lack of evaluation mechanism and transparent approval procedures in supervision; no, the formation of unified supervision and management system, the development speed of supervision means has not complied with the website. There is a problem, any country will face in the legal system of a country, economy and politics, history and culture are closely related. How to face the problem and solve the problem in time according to the development of itself is the most important. To solve these problems, we need based on the actual situation in China, the unified legislation guiding ideology, to speed up the administrative licensing business website to accelerate the establishment of a unified legislation; Supervision and management system.
