【摘要】：在市場經(jīng)濟運行過程中,行業(yè)協(xié)會能夠有效彌補市場機制和政府干預雙重“失靈”的缺陷,規(guī)范市場主體的行為,其自律功能逐漸得到社會各界的關注和認同,成為經(jīng)濟生活中不可或缺的市場主體。農(nóng)夫山泉“標準門”事件中,相關行業(yè)協(xié)會對農(nóng)夫山泉違規(guī)行為的應對措施暴露出我國行業(yè)協(xié)會存在錯位、缺位、越位等亂象,究其原因是行業(yè)協(xié)會缺少有效的自律機制,未能充分發(fā)揮應有的自律作用。因此,構建行業(yè)協(xié)會自律機制是我國發(fā)展行業(yè)協(xié)會的主要任務之一。 目前我國行業(yè)協(xié)會相關立法滯后、內(nèi)部結構不健全、自治程度低等各種障礙性因素制約了行業(yè)協(xié)會自律機制的建設。本文以檢討行業(yè)協(xié)會自律的現(xiàn)狀為基礎,針對行業(yè)協(xié)會自律機制存在的各種問題,擬從內(nèi)、外兩個方面提出發(fā)展與完善行業(yè)協(xié)會自律機制的建議與措施。
[Abstract]:In the course of market economy operation, trade associations can effectively remedy the defects of market mechanism and government intervention, standardize the behavior of market subjects, and gradually get attention and recognition from all walks of life.Become an indispensable market subject in economic life.In the "Standard Gate" incident of Farmers' Springs, the measures taken by relevant trade associations to deal with violations of the regulations in Farmers' Springs exposed the confusion of the trade associations in our country, such as dislocation, absence and offside, which is due to the lack of effective self-discipline mechanism of trade associations.Fail to give full play to due self-discipline.Therefore, the construction of industry association self-discipline mechanism is the main Ren Wuzhi of China's development industry association.At present, the construction of self-discipline mechanism of trade association is restricted by various obstacles such as lagging legislation, imperfect internal structure and low degree of autonomy.Based on the review of the current situation of self-discipline of trade associations, this paper aims at various problems existing in self-discipline mechanism of trade associations, and puts forward suggestions and measures to develop and perfect self-discipline mechanism of trade associations from two aspects: internal and external.
