【摘要】：目前,我國正處于社會發(fā)展的轉(zhuǎn)型時期,各種社會矛盾凸顯。社會保障體系的不健全加上貧富差距的懸殊,為我國和諧社會的建設(shè)增加了不少難題。而公益事業(yè)以其公益道德屬性,在扶貧、助學(xué)、救災(zāi)等方面發(fā)揮了重要作用,定程度上緩解了社會矛盾。但是近幾年,傳統(tǒng)公益組織不斷傳出負面事件,受這些負面事件的影響,社會公眾對傳統(tǒng)公益組織的信任降到了冰點。而伴隨著微博的興起和廣泛應(yīng)用,“微博公益”這種新型的公益組織模式誕生了。微博公益組織在微博上聚集了很多的愛心和善心,開展了各種符合民意的微博公益活動,為我國公益事業(yè)的發(fā)展注入了新的力量。但是微博公益作為新生事物,其發(fā)展之迅猛有利也有弊。當(dāng)前,我國對微博公益組織的監(jiān)管很多方面還處于空白狀態(tài),立法上的缺失、政府監(jiān)管的不到位、微博公益組織內(nèi)部制約機制的不健全等,這些因素都將制約我國微博公益組織未來的發(fā)展道路。為了促進我國公益事業(yè)及微博公益組織的長遠發(fā)展,必須首先在立法上加強對微博公益組織的監(jiān)管。本文在個案分析、定性分析的基礎(chǔ)上,概括當(dāng)前我國微博公益組織法律監(jiān)管現(xiàn)狀及存在的主要問題,最后結(jié)合我國實際對微博公益組織監(jiān)管提出了幾點立法建議。 本文正文部分包括第二、三、四章三大部分。第二章首先引入“免費午餐”涉嫌洗錢的事例,介紹了公益的實質(zhì),然后對微博公益內(nèi)涵進行界定。最后,從社會學(xué)和法學(xué)角度對微博公益組織監(jiān)管的理論基礎(chǔ)進行分析。第三章通過近幾年發(fā)生的公益危機事件如“郭美美事件”、“成都捐款箱內(nèi)捐款發(fā)霉事件”等分析概括了當(dāng)前我國公益事業(yè)存在的一些問題；結(jié)合“大愛清塵”組織模式和運行現(xiàn)狀分析微博公益在當(dāng)下的優(yōu)勢及強大的發(fā)展?jié)摿?進而總結(jié)微博公益組織在我國的發(fā)展現(xiàn)狀及存在的問題；總結(jié)我國當(dāng)前微博公益組織的法律依據(jù),并分析我國微博公益組織監(jiān)管立法上的不足。第四章則結(jié)合微博公益組織的發(fā)展實際提出了幾點立法建議。
[Abstract]:At present, our country is in the transition period of social development, various social contradictions. The social security system is not sound and the gap between the rich and the poor, increase a lot of problems for the construction of a harmonious society in China. And the public welfare to its public moral attributes, in poverty alleviation, education, play an important role in disaster relief. To some extent alleviate the social contradiction. But in recent years, the traditional public organizations continue to spread the negative events affected by these negative events, the public trust of traditional public organizations has dropped to the freezing point. With the emergence and widespread application of micro-blog, "micro-blog public welfare organization" of this new model was born. Micro-blog public welfare organizations gathered in micro-blog a lot of love and kindness, to carry out a variety of micro-blog with public opinion, public welfare activities, the new vigor into the development of China's public welfare. But micro-blog public As a new thing, its rapid development has advantages and disadvantages. At present, China's regulation of the micro-blog charity organization in many aspects is still blank, the lack of legislation, government regulation is not in place, micro-blog public welfare organization internal control mechanism is not perfect, these factors will restrict China's micro-blog charity organization in the future the road of development. In order to promote the long-term development of China's public welfare and micro-blog public organizations, must strengthen the supervision of the micro-blog charity organization in the legislation. Based on the case analysis, based on qualitative analysis, summarized the current status of legal supervision of China's micro-blog charity organization and the main problems, finally unifies our country actual a few some legislative suggestions for micro-blog supervision of public organizations.
This paper consists of second, third chapters, four three parts. The second chapter first introduced the "free lunch" suspected of money laundering case, introduces the essence of public interest, then micro-blog public definition. Finally, analyze the theoretical basis of micro-blog supervision of public organizations from the perspective of sociology and law. The third chapter in recent years the public crisis events such as the "Jocie Guo incident", "Chengdu donation donation box moldy incident" analyses and summarizes some existing problems of China's public welfare undertakings; analysis of advantages of micro-blog charity in the moment and strong development potential with "love clean dust" organization mode and operation status, and then summarize the micro-blog charity organization in development the status quo and problems of China's current legal basis; summarize the micro-blog charity organization, and analyze the legislative supervision of micro-blog public organizations in our country on the foot In the fourth chapter, some legislative proposals are put forward in combination with the development of micro-blog public welfare organization.
