【摘要】：行政問責在我國大陸地區(qū)的確立及發(fā)展具有鮮明的本土特色。實現(xiàn)行政問責的法治化,構(gòu)成我國行政問責得以良性發(fā)展的必然選擇和根本出路。而法治的實現(xiàn)需要法律的制定、實施與保障機制的有機統(tǒng)一。本文旨在通過對包括問責的基本原則、歸責原則、構(gòu)成要件以及問責主體、問責對象、問責范圍、問責程序、問責方式及其適用等立法過程中必須解決的關(guān)鍵性問題的研究,以便為探索適宜我國問責法治化之發(fā)展路徑提供重要突破口和切入點。
[Abstract]:The establishment and development of administrative accountability in the mainland of China has distinct local characteristics. To realize the rule of law of administrative accountability constitutes the inevitable choice and fundamental outlet for the benign development of administrative accountability in our country, and the realization of the rule of law requires the formulation of laws. The purpose of this paper is to analyze the basic principles of accountability, the principle of imputation, the constitutive elements, the subject, the object, the scope and the procedure of accountability. The research on the key issues in the legislative process such as the way of accountability and its application provides an important breakthrough and breakthrough point for exploring the development path suitable for the rule of law of accountability in our country.
