【摘要】：近期安樂(lè)死問(wèn)題又起波瀾,比利時(shí)、加拿大、法國(guó)在立法上都有突破。在我國(guó),安樂(lè)死贊成與反對(duì)聲音都很強(qiáng)烈,立法時(shí)機(jī)不成熟,但現(xiàn)實(shí)中存在非法安樂(lè)死案例,對(duì)立法形成挑戰(zhàn)。作為放棄治療的消極安樂(lè)死卻支持者眾多,不少?lài)?guó)家和地區(qū)基本上立法也都認(rèn)可。我國(guó)消極安樂(lè)死普遍存在,但缺乏立法規(guī)制,因而隱藏著放棄治療實(shí)施故意殺人的可能,對(duì)患者近親屬和醫(yī)務(wù)人員都面臨被追究刑事責(zé)任的風(fēng)險(xiǎn),通過(guò)對(duì)我國(guó)消極安樂(lè)死(即放棄治療)立法調(diào)研和當(dāng)前實(shí)際工作中放棄治療,提出了相應(yīng)對(duì)策,認(rèn)可患者簽署的放棄治療意愿書(shū)和委托書(shū)法律效力,實(shí)施中應(yīng)加強(qiáng)審批、監(jiān)督,并做詳細(xì)記錄。
[Abstract]:The issue of euthanasia has been on the rise recently. Belgium, Canada, and France have all made breakthroughs in legislation. In our country, euthanasia is very strong in favor and opposition, and the legislative time is not ripe, but in reality there are cases of illegal euthanasia. The negative euthanasia, which is regarded as giving up treatment, has many supporters, and many countries and regions basically accept it. Negative euthanasia is common in our country, but it lacks legislative regulation. Thus hiding the possibility of giving up treatment to carry out intentional homicide, and facing the risk of being investigated for criminal responsibility to patients' close relatives and medical personnel. Through the research on the legislation of passive euthanasia (i.e. abandonment of treatment) in our country and the practice of giving up treatment at present, the corresponding countermeasures are put forward, and the legal effect of the willingness to abandon treatment and the power of attorney signed by the patient is recognized, and the examination and approval and supervision should be strengthened in the implementation. And make detailed records.
