【摘要】：改革開放以來,國(guó)家社會(huì)飛速發(fā)展,市場(chǎng)經(jīng)濟(jì)體制逐步健全,相應(yīng)地,對(duì)政府的角度定位、職能定位也要重新設(shè)定�，F(xiàn)在,我國(guó)政府正在由傳統(tǒng)的職能型政府逐步地向新型的服務(wù)型政府轉(zhuǎn)變,這是政府當(dāng)前工作的主題和目標(biāo),也是政府預(yù)防、應(yīng)對(duì)、解決政府失靈境況的方法。在這一過程中,最突出的表現(xiàn)就是越來越多的政府職能開始被下放,眾多行政審批項(xiàng)目的取消和調(diào)整,而承接這些政府職能的就是包括公益組織在內(nèi)的眾多中國(guó)社會(huì)組織。社會(huì)組織的功能價(jià)值正由此來實(shí)現(xiàn)。 我國(guó)公益組織的興起且高速發(fā)展時(shí)期已然來臨,預(yù)示著公益組織愈來愈靠近實(shí)現(xiàn)其服務(wù)于社會(huì)公共利益這一最基本的角色定位和價(jià)值定位的目標(biāo),公益組織的蓬勃發(fā)展勢(shì)在必行。當(dāng)代社會(huì)是法治社會(huì),只有當(dāng)公益組織的法律主體地位得到確立、鞏固和保障,相關(guān)的法律主體地位問題得到有效解決,才能對(duì)公益組織進(jìn)行有效、明確的監(jiān)管,從而使公益組織在當(dāng)前環(huán)境下?lián)碛辛己玫陌l(fā)展勢(shì)頭與潛力,積極開展組織活動(dòng),以實(shí)現(xiàn)組織的價(jià)值功能。 本文主要內(nèi)容如下： 引論：主要說明了本文寫作和探討的主要問題和相關(guān)文獻(xiàn)綜述。 第二章主要內(nèi)容是公益組織的概述。主要介紹了關(guān)于公益組織的概念、特征、理論解釋、職能屬性,法律主體地位等。 第三章主要分析了我國(guó)公益組織法律主體的現(xiàn)狀及問題成因,介紹了我國(guó)公益組織的法律形式,對(duì)公益組織法律主體地位發(fā)展的歷史時(shí)期和現(xiàn)行時(shí)期進(jìn)行了梳理,分析我國(guó)公益組織法律主體地位的現(xiàn)狀進(jìn),并剖析成因所在。 第四章主要闡述了域外公益組織法律主體地位的概況。分別介紹了美國(guó)、英國(guó)、日本這三國(guó)關(guān)于公益組織法律主體地位的法律體系和制度建設(shè)。期望由此對(duì)我國(guó)公益組織法律主體地位的完善能夠提供借鑒和經(jīng)驗(yàn)。 第四章主要內(nèi)容是如何完善我國(guó)公益組織法律主體地位的具體措施和制度設(shè)計(jì)。先后從立法層面、法律原則、管理機(jī)制、監(jiān)管體系、救濟(jì)途徑、法律鼓勵(lì)措施等方面提出了完善措施。 結(jié)語：對(duì)全文進(jìn)行了總結(jié),肯定了對(duì)公益組織主體地位的研究的積極意義。
[Abstract]:Since the reform and opening up, the national society has developed rapidly, and the market economic system has been gradually improved. Accordingly, the government's angle of view and function orientation should also be re-set. Now, Our government is gradually changing from the traditional functional government to the new service-oriented government, which is the main theme and goal of the government's current work, and is also the way for the government to prevent, cope with, and solve the malfunction of the government. The most outstanding performance is that more and more government functions have been decentralized, and many administrative examination and approval projects have been cancelled and adjusted. These government functions are carried out by many Chinese social organizations, including public welfare organizations. The rise and rapid development of public welfare organizations in China has come, indicating that public welfare organizations are getting closer and closer to the goal of serving the social public interest, which is the most basic role orientation and value orientation. The flourishing development of public welfare organizations is imperative. The contemporary society is a society ruled by law, only when the legal subject status of public welfare organizations is established, consolidated and guaranteed, the relevant legal subject status issues are effectively resolved. Only then can the public welfare organization be supervised effectively and clearly, so that the public welfare organization can have good development momentum and potential under the current environment, and carry out the organization activities actively in order to realize the value function of the organization. The main contents of this paper are as follows:. Introduction: this article mainly explains the main problems and literature review. The second chapter mainly introduces the concept, characteristics, theoretical explanation, functional attributes and legal subject status of public welfare organization. The third chapter mainly analyzes the status quo and causes of the legal subjects of public welfare organizations in China, introduces the legal forms of public welfare organizations in China, and combs the historical period and current period of the development of the legal subject status of public welfare organizations. This paper analyzes the status quo of the legal subject status of public welfare organizations in China, and analyzes the causes. Chapter 4th mainly expounds the general situation of the legal subject status of the extraterritorial public welfare organizations. The legal system and system construction of the legal subject status of public welfare organizations in Japan is expected to provide reference and experience for the perfection of the legal subject status of public welfare organizations in China. The main content of Chapter 4th is how to perfect the concrete measures and system design of the legal subject status of the public welfare organization in China, successively from the legislative level, the legal principle, the management mechanism, the supervision system, the relief way, Legal incentives and other aspects of the proposed improvement measures. Conclusion: summarizes the full text and affirms the positive significance of the research on the subject status of public welfare organizations.
