【摘要】：目前,仍然存在政府過度干預大學自主辦學、學校內部行政權力與學術權力未分離、師生權利保障機制不健全等問題。我國大學章程建設工作取得了可喜的成績,但仍然存在一些問題,如大學與政府的關系到底如何?作為大學主體師生的權利如何保障落實?大學章程作為大學的"憲法",是制定學校其他規(guī)章制度的基礎,同時對依法治校、大學自治、學術自由與構建現(xiàn)代大學制度具有十分重要的意義。因此,有必要對大學章程加以研究。論文共分為五部分:第一部分,主要介紹大學章程的內涵、法律性質、法律地位;第二部分,敘述現(xiàn)階段大學章程存在的問題:大學章程法律地位低,內外部關系規(guī)定籠統(tǒng),缺乏章程修改程序性規(guī)定,特色不夠鮮明;第三部分,針對第二部分存在的問題,分析原因;第四部分,介紹域外大學章程經(jīng)驗:突出大學理念和使命,明確大學辦學目標,細化師生權利、義務及處分程序和救濟途徑,重視大學對外關系;第五部分,針對第二部分存在的問題,提出完善建議:提升大學章程法律地位,具體化大學內外部關系規(guī)定,規(guī)范章程修改程序,彰顯學校特色。
[Abstract]:At present, there are still excessive government intervention in the independence of University, the school internal administrative power and academic power separation, safeguard mechanism of the rights of teachers and students is not perfect and so on. Work rules for the construction of university has made gratifying achievements, but there are still some problems, such as the relationship between the University and the government in the end how? As a university subject of teachers and students the right to to guarantee the implementation of the Charter of the University as a university? "Constitution" is the basis for making the school regulations, at the same time, the rule of law, university autonomy, academic freedom has very important significance and the construction of modern university system. Therefore, it is necessary to study on the Charter of the University. The thesis is divided into five parts: the first part, the connotation. Mainly introduces the constitution of university legal nature, legal status; the second part describes the present university charter problem: the Charter of the university legal status is low, the internal and external relations. Set the general lack of procedural provisions to amend the constitution, the character is not obvious; the third part, the second part of the problems, analyze the reasons; fourth part introduces extraterritorial statutes of the University experience: a prominent university philosophy and mission, a clear goal of university education, teachers and students to refine the rights, obligations and disciplinary procedures and remedies, attach importance to the University's foreign relations the fifth part; in the second part of the existing problems, puts forward some suggestions: improve the legal status of university regulations, provisions of the internal and external relations of university regulations, modify the program to highlight the characteristics of the school.
