長江經(jīng)濟帶綠色發(fā)展法律保障問題研究

【摘要】:長江經(jīng)濟帶作為中國開發(fā)歷史最久、人口經(jīng)濟分布最為集中的地區(qū)之一,是世界上規(guī)模最大的內河經(jīng)濟產(chǎn)業(yè)帶,在中國經(jīng)濟發(fā)展中占有重要地位。同時,長江經(jīng)濟帶還是我國重要的生態(tài)寶庫,生態(tài)區(qū)位重要,生態(tài)類型多樣,生物多樣性豐富。改革開放以來,長江經(jīng)濟帶經(jīng)濟社會迅猛發(fā)展,綜合實力快速提升,成為我國的經(jīng)濟重心所在、活力所在。但是高強度的開發(fā)建設以及高密度的人口產(chǎn)業(yè)布局也使得經(jīng)濟帶環(huán)境承載量銳減,環(huán)境污染負荷增大,嚴重威脅長江經(jīng)濟帶的可持續(xù)發(fā)展。十八屆五中全會提出了“綠色發(fā)展”新理念,更加強調經(jīng)濟發(fā)展、社會運行等各方面對自然生態(tài)環(huán)境的保護。因此,綠色發(fā)展成為長江經(jīng)濟帶建設的核心目標,堅持生態(tài)優(yōu)先原則,預防和治理環(huán)境污染,保護自然資源,加強生態(tài)修復和保護成為長江經(jīng)濟帶綠色發(fā)展主要任務。本研究首先從長江經(jīng)濟帶綠色發(fā)展的理論基礎入手,對長江經(jīng)濟帶進行了概念界定和解讀,對綠色發(fā)展的理論內涵和基本目標進行了闡述,并對長江經(jīng)濟帶綠色發(fā)展的法治化需求進行了分析。同時對相關基礎理論進行了概述,包括法學理論中的利益與利益機制理論、可持續(xù)發(fā)展理論和宏觀調控理論;經(jīng)濟學理論中的生態(tài)經(jīng)濟理論和經(jīng)濟外部性理論,以及生態(tài)學理論中的生態(tài)整體主義理論,從而為研究長江經(jīng)濟帶綠色發(fā)展法律保障問題奠定理論基礎。其次,對長江經(jīng)濟帶生態(tài)環(huán)境現(xiàn)狀、流域管理現(xiàn)狀進行了分析,從國家層面、流域層面和地方層面對長江經(jīng)濟帶綠色發(fā)展涉及的相關法律法規(guī)及規(guī)范性文件進行了梳理,總結分析了長江經(jīng)濟帶綠色發(fā)展過程中存在的法律制度缺陷和運行機制的不協(xié)調。再次,對國外典型流域發(fā)展過程中的法律保障制度設計和運行措施進行了具體分析,總結歸納出對長江經(jīng)濟帶綠色發(fā)展法律保障有益的經(jīng)驗借鑒。最后,提出構建長江經(jīng)濟帶綠色發(fā)展法律保障體系的建議,依據(jù)生態(tài)優(yōu)先原則、協(xié)同合作原則和綜合治理原則,構建以《長江流域發(fā)展法》為核心的流域立法體系,同時構建以長江經(jīng)濟帶綠色發(fā)展主體法律制度、流域規(guī)劃制度、生態(tài)環(huán)境責任制度、綠色發(fā)展糾紛解決制度以及生態(tài)補償制度為主體的長江經(jīng)濟帶綠色發(fā)展法律保障制度體系,并從設置統(tǒng)一的流域管理機構,完善長江經(jīng)濟帶生態(tài)文明績效考核體系,合理布局長江經(jīng)濟帶產(chǎn)業(yè)結構、發(fā)展綠色產(chǎn)業(yè)和循環(huán)經(jīng)濟以及構建多元化公眾參與機制等方面為長江經(jīng)濟帶綠色發(fā)展法律保障制度的良好運行提供對策建議。
[Abstract]:As one of the regions with the longest history of development and the most concentrated population and economy, the Yangtze River Economic Zone is the largest inland river economic industrial belt in the world and plays an important role in China's economic development. The Yangtze River Economic Zone is also an important ecological treasure house in China, with important ecological areas, diverse ecological types and rich biodiversity. Since the reform and opening up, the economy and society of the Yangtze River Economic Belt have developed rapidly and its comprehensive strength has been rapidly enhanced. It has become the center of economic gravity and vitality of our country. However, the high intensity of development and construction as well as the high density of population industrial layout have also made the environmental load of the economic belt sharply reduced and the environmental pollution load increased. The fifth plenary session of the 18 CPC Central Committee put forward a new concept of "green development", which emphasizes the protection of the natural ecological environment from various aspects, such as economic development and social operation. Green development has become the core goal of the construction of the Yangtze economic belt. It adheres to the principle of ecological priority, prevents and controls environmental pollution, and protects natural resources. Strengthening ecological restoration and protection has become the main task of the green development of the Yangtze River economic belt. This study begins with the theoretical basis of the green development of the Yangtze River economic belt, and defines and interprets the concept of the Yangtze economic belt. This paper expounds the theoretical connotation and basic goal of green development, and analyzes the legal requirements of green development in the Yangtze economic belt. At the same time, it summarizes the relevant basic theories, including the theory of interest and benefit mechanism in the theory of law. Sustainable development theory and macro-control theory, ecological economic theory and economic externality theory in economic theory, ecological holism theory in ecological theory, Therefore, it lays a theoretical foundation for the study of the legal guarantee of the green development of the Yangtze Economic Belt. Secondly, the present situation of the ecological environment of the Yangtze Economic Belt and the present situation of the watershed management are analyzed, and at the national level, At the watershed level and local level, the relevant laws, regulations and normative documents related to the green development of the Yangtze economic belt are sorted out. This paper summarizes and analyzes the defects of the legal system and the disharmony of the operating mechanism in the process of green development of the Yangtze economic belt. Thirdly, the design and operation measures of the legal guarantee system in the development process of the typical watersheds abroad are analyzed concretely. This paper sums up some useful experiences for the legal guarantee of the green development of the Yangtze River Economic Belt. Finally, it puts forward some suggestions for constructing the legal guarantee system of the green development of the Yangtze Economic Belt, according to the principle of ecological priority, the principle of cooperation and the principle of comprehensive management. At the same time, it constructs the legal system of the main body of the green development of the Yangtze River economic belt, the watershed planning system, the system of ecological environmental responsibility, and the legislation system of the river basin with the Yangtze River Basin Development Law as the core. Green development dispute resolution system and ecological compensation system as the main body of the Yangtze River economic belt green development legal protection system, and from the establishment of a unified watershed management institutions, improve the Yangtze River economic belt ecological civilization performance appraisal system, The rational distribution of the industrial structure of the Yangtze Economic Belt, the development of green industry and circular economy, and the construction of a diversified public participation mechanism provide countermeasures and suggestions for the good operation of the legal guarantee system for the green development of the Yangtze Economic Belt.
