【摘要】：目前我國環(huán)境法學(xué)界對環(huán)境法的本位這一主題的解讀多是在實證、工具層面的,此與傳統(tǒng)法理學(xué)在應(yīng)然價值層面探究法的本位問題的思路是相左的;同時,有關(guān)環(huán)境法本位的誤讀和爭議又進一步引發(fā)了學(xué)界在實在法律規(guī)則層面對環(huán)境法保障手段的"單一化"的解讀。這顯然不利于準(zhǔn)確定位環(huán)境法的價值目標(biāo),也有礙于環(huán)境法律體系的合理構(gòu)建。環(huán)境法學(xué)界應(yīng)回歸部門法理學(xué)之本里,從價值層面確立并正確解讀環(huán)境法的權(quán)利本位,并以之為基礎(chǔ)正視環(huán)境法的"多元化"保障手段及其配合機制。具體來看該配合機制表現(xiàn)為"一體兩翼一支撐":即環(huán)境行政權(quán)力是核心保障手段;社會環(huán)境權(quán)力和自然人環(huán)境權(quán)利是輔助保障手段;環(huán)境義務(wù)是環(huán)境法各保障手段的支撐。
[Abstract]:At present, the interpretation of the theme of the standard of environmental law in the field of environmental law in our country is mostly at the level of demonstration and tool, which is different from the idea of exploring the standard problem of law in the level of natural value of traditional jurisprudence; at the same time, The misreading and controversy about the standard of environmental law further lead to the "unitary" interpretation of the means of environmental protection in the academic circles at the level of positive legal rules, which is obviously not conducive to the accurate positioning of the value goal of environmental law. It also hinders the rational construction of the environmental legal system. The environmental law field should return to the foundation of departmental jurisprudence and establish and correctly interpret the right standard of environmental law from the value level. And on the basis of this, we should face up to the "pluralistic" safeguard means of environmental law and its coordination mechanism, which is shown as "one body, two wings and one support": that is, the environmental administrative power is the core safeguard means; Social environmental rights and natural environmental rights are auxiliary safeguards, and environmental obligations are the support of environmental law.
