【摘要】:根據(jù)中國行業(yè)研究網(wǎng)公布的數(shù)據(jù),截止到2013年底,中國汽車保有量達(dá)到了1.37億輛,從2000年的汽車保有量1600萬輛到1.37億輛,僅僅用了13年,隨著汽車業(yè)的迅猛發(fā)展,一方面是經(jīng)銷商、車企、保險公司、政府享受了車市迅猛發(fā)展帶來的紅利,另一方面也突顯了一些由此帶來的不利因素,比如有增無減、居高不下的交通事故,在以往的交事故當(dāng)中,車主一般只要求將事故車輛修復(fù)達(dá)標(biāo)即告完成,然而近幾年,,隨著車主維權(quán)意識的提高,越來越多地關(guān)注到自身權(quán)利的維護(hù),發(fā)生交通事故之后,受損車主向法院訴訟要求保險公司賠償車輛貶值損失的案例也越來越多,但是由于目前相關(guān)的法律、法規(guī)并沒有明確具體的規(guī)定,形成了車輛貶值損失在“商業(yè)三者險”中的索賠真空,對車輛貶值損失的性質(zhì)?“商業(yè)三者險”的保險人是否要承擔(dān)賠償責(zé)任?在何種條件下承擔(dān)賠償責(zé)任?賠償?shù)绞裁闯潭龋康纫幌盗袉栴},理論界與實(shí)務(wù)界是意見不一,實(shí)務(wù)中同案不同判的情形屢見不鮮。本文將對“商業(yè)三者險“與車輛貶值損失進(jìn)行論證分析并提出解決方案,希望通過對車輛貶值損失形成的原因、性質(zhì)以及相關(guān)立法缺陷的分析,提出建議,以期能盡快完善我國“商業(yè)三者險”保險人對車輛貶值損失的賠償制度。 具體的研究工作包括:一、通過三個同案不同判的案例,指出我國目前車輛貶值損失在“商業(yè)三者險“中的理賠現(xiàn)狀及存在的問題;二、根據(jù)我國《民法通則》、《保險法》《侵權(quán)責(zé)任法》等相關(guān)法律規(guī)定,分析車輛貶值損失的概念、性質(zhì)、構(gòu)成要件和權(quán)利義務(wù)主體;三、闡述“商業(yè)三者險”保險人對車輛貶值損失賠償?shù)乃痉▽?shí)踐及司法實(shí)踐中急需解決的問題;四、闡述完善我國“商業(yè)三者險”中保險人對車輛貶值損失賠償制度的意義;五、闡述“商業(yè)三者險”中保險人對車輛貶值損失承擔(dān)賠償責(zé)任的理論依據(jù)與法理依據(jù),進(jìn)而提出完善的具體措施,讓車輛貶值損失通過科學(xué)、權(quán)威的專業(yè)機(jī)構(gòu)進(jìn)行鑒定得以確定,并且能夠在“商業(yè)三者險”中及時有效的獲得理賠。
[Abstract]:According to data released by China Industry Research Network, by end of 2013, the number of cars in China had reached 137 million, from 16 million to 137 million vehicles in 2000, which took only 13 years. With the rapid development of the automobile industry, On the one hand, dealers, car companies, insurance companies, and the government enjoy the dividends brought by the rapid development of the car market. On the other hand, it also highlights some of the unfavorable factors brought about by this, such as unabated and high traffic accidents. In the past traffic accidents, car owners generally only required that the repair of the accident vehicles be completed. However, in recent years, with the improvement of the awareness of the owners' rights, more and more attention has been paid to the maintenance of their own rights, and after the traffic accidents, There are more and more cases in which the owner of the damage has sued the court for the insurance company to compensate for the depreciation loss of the vehicle. However, due to the current relevant laws and regulations, there is no clear and specific provision. Has formed the vehicle depreciation loss in "the commercial three risks" the claim vacuum, to the vehicle depreciation loss nature? Should the insurer of "Commercial three risks" bear liability for compensation? Under what conditions should liability be assumed? To what extent? There are different opinions between the theorists and the practitioners, and the cases of different judgments in the same cases in practice are not uncommon. This paper will demonstrate and analyze the "three risks of commerce" and the loss of depreciation of vehicles, and put forward solutions. It is hoped that through the analysis of the causes, nature and related legislative defects of the devaluing loss of vehicles, some suggestions can be put forward in order to improve the compensation system of the "commercial three risks" insurers for the devaluing loss of vehicles as soon as possible. The specific research work includes: first, through three cases of different judgments in the same case, pointing out the current situation and existing problems of vehicle depreciation losses in the "commercial three risks" in our country. According to the relevant laws and regulations, such as "General principles of Civil Law", "Insurance Law" and "Tort liability Law", this paper analyzes the concept, nature, constituent elements and subject of rights and obligations of devaluing loss of vehicles. This paper expounds the judicial practice of "commercial three risks" insurers and the problems urgently needed to be solved in judicial practice; fourthly, expounds the significance of perfecting the insurer's compensation system for vehicle depreciation losses in China's "commercial three risks"; This paper expounds the theoretical basis and the legal basis of the insurer's liability for the loss of depreciation of the vehicle in "Commercial three risks", and then puts forward some concrete measures to make the loss of depreciation of the vehicle be determined by scientific and authoritative professional organizations. And can be in the "commercial three risks" timely and effective settlement of claims.
