【摘要】：由于受到城鄉(xiāng)二元土地管理結(jié)構(gòu)的限制,目前一些城市在城中村改造中,對(duì)舊宅基地的退出與流轉(zhuǎn)模式始終沒有跳出"一宅兩制"的制度限制,包括宅基地置換等模式,依然具有"被征收""被退出與流轉(zhuǎn)"的性質(zhì)。因此,文章以漸進(jìn)的形式構(gòu)建一種通過宅基地入股到宅基地信托制,并最終建立復(fù)合型所有制形式的城中村舊宅基地退出與流轉(zhuǎn)路徑,將對(duì)"城中村"舊宅基地的改造利用具有十分重要的借鑒價(jià)值。
[Abstract]:Because of the restriction of urban and rural dual land management structure, at present, some cities have not jumped out of the system of "one house and two systems" in the transformation of urban villages, including the replacement of housing sites. It still has the nature of "being expropriated" and "being withdrawn and transferred". And the final establishment of the compound form of ownership of the old urban village homestead exit and circulation path will be "village in the city" of the old homestead transformation and utilization of a very important reference value.
