【摘要】：環(huán)境罰款是以威懾功能為核心的環(huán)境財產(chǎn)罰,欲準確確定環(huán)境罰款數(shù)額,需要科學(xué)立法和精準裁量的雙重保障�，F(xiàn)階段環(huán)境罰款組成不完整、數(shù)額設(shè)定方式不恰當(dāng)以及裁量基準體系不系統(tǒng),導(dǎo)致環(huán)境罰款“數(shù)額低、標(biāo)準不統(tǒng)一、裁量肆意”。在未來完善環(huán)境罰款數(shù)額確定規(guī)則的實踐中,應(yīng)以適當(dāng)威懾為整體制度目標(biāo),對現(xiàn)有立法和裁量規(guī)則體系加以調(diào)整。在立法中,確立包含違法情節(jié)罰款和違法收益罰款的環(huán)境罰款組成。同時,根據(jù)不同環(huán)境罰款組成的特征,選擇不同罰款設(shè)定方式,即以概括式的方式設(shè)定違法收益罰款,以數(shù)值數(shù)據(jù)式的方式設(shè)定違法情節(jié)罰款。在裁量中,運用“二維網(wǎng)格式”裁量基準分格技術(shù)構(gòu)建裁量基準規(guī)則,并確立體系化的裁量調(diào)整規(guī)則。
[Abstract]:Environmental penalty is a kind of environmental property penalty with deterrent function as the core. In order to accurately determine the amount of environmental penalty, both scientific legislation and precise discretion are needed. At this stage, the composition of environmental penalty is incomplete. The inappropriate way of setting the amount and the unsystematic system of the discretionary benchmark result in "low amount, inconsistent standard and arbitrary discretion". In the practice of perfecting the rules for determining the amount of environmental penalty in the future, the overall objective of the system should be the appropriate deterrence. Adjust the existing legislation and the system of discretionary rules. In the legislation, establish the composition of environmental fines that contain fines for the circumstances of the violation and fines for proceeds of the violation. At the same time, according to the characteristics of the composition of different environmental fines, choose different ways of setting fines, That is to say, the penalty for illegal proceeds is set up in a general way, and the fine for illegal circumstances is set up in the form of numerical data. And establish the system of discretion adjustment rules.
