【摘要】：以基層法院y法院為調研樣本,從主體、階段、問題、訴求、方式等方面來論述基層涉訴信訪的概念；闡明基層涉訴信訪與涉法信訪、行政信訪、訴訟程序、非訴訟程序的區(qū)別；深入分析基層涉訴信訪的的現(xiàn)狀,即信訪總量基數(shù)仍在高位運行,信訪形式逐漸異化,信訪人訴求所涉內容越來越多樣化,司法職能與信訪維穩(wěn)責任相疊加,涉訴信訪體制機制不夠完善,司法行政化傾向客觀上增加了社會矛盾的化解成本；從y法院健全機構、規(guī)范程序、判后答疑、加強評估、定期通報、多元化解、約期接談、因案施策、司法救助等方面,剖析基層法院涉訴信訪處置制度；針對當下基層涉訴信訪工作存在的困境難題,就微觀層面從理論上和實踐上對進一步完善涉訴信訪工作機制提出建議：從理論上理清“三種關系”(淵源之辯——正式性與非正式性,存廢之爭--消積性與積極性,基層之殤——合法性與非法性)；從實踐中完善“四個機制”,即建立健全對違法上訪的追究機制,制訂全省統(tǒng)一的《涉訴信訪管理辦法》,實行訴訪分離制度,規(guī)定涉訴信訪終結制度,加大對違法上訪的處罰力度；建立完善法官自由裁量權的規(guī)制,確定法官自由裁量權的基本原則、正確方法、規(guī)制路徑,提高法官自由裁量權能力；構建“四位一體、整體聯(lián)動”大調解工作體系,闡述其工作原則及目標任務,機構職能及工作職責,工作流程及運行機制；完善涉訴信訪司法救助保障機制,明確司法救助基金的適用對象,拓寬司法救助基金的籌集渠道,規(guī)范司法救助基金的管理使用。
[Abstract]:Taking the basic court y court as the research sample, this paper discusses the concept of complaint petition from the aspects of subject, stage, problem, demand, method and so on. Clarify the difference between the basic level litigation petition and the law related petition, the administrative petition, the lawsuit procedure, the non-litigation procedure; In-depth analysis of the status of grass-roots complaint petition, that is, the total number of letters and visits is still running at a high level, the form of letters and visits gradually dissimilated, the content of petitioners' demands is more and more diverse, the judicial function and the responsibility of maintaining the stability of letters and visits are superimposed. The mechanism of petition system is not perfect, and the tendency of judicial administration increases the cost of resolving social contradictions objectively. From y court perfect the organization, the standard procedure, after the sentence answers the question, strengthens the appraisal, the periodic announcement, the pluralistic solution, the contract period accepts the discussion, because of the case the strategy, the judicial aid and so on aspect, analyzes the basic level court involves in the lawsuit letter to visit the disposition system; In the light of the difficulties existing in the work of complaint letters and visits at the lower level. On the micro level, the author puts forward some suggestions on how to improve the working mechanism of complaint petition in theory and practice: to clarify the "three kinds of relations" in theory (argument of origin-formality and informality). The debate of saving and abolishing-eliminating accumulation and enthusiasm, the basic level of mourning-legality and illegality; In practice, we should perfect the "four mechanisms", that is, we should establish and improve the investigation mechanism for illegal petitions, formulate the unified management measures for petition and petition in the whole province, implement the system of separation of complaints and visits, and stipulate the system of termination of petitions and visits. To increase the punishment of illegal petition; Establish and perfect the regulation of the judge's discretion, determine the basic principle of the judge's discretion, correct method, regulation path, improve the judge's discretion ability; Construct the "four-in-one, whole linkage" mediation work system, expound its work principle and target task, organization function and work responsibility, work flow and operation mechanism; We should perfect the mechanism of the judicial assistance and assistance system, clarify the applicable object of the judicial aid fund, broaden the channels of raising the judicial aid fund, and standardize the management and use of the judicial aid fund.
