【摘要】：冷戰(zhàn)結束后,作為僅剩的超級大國,美國的軍事實力毋容置疑。但是在2001年9月11日,恐怖分子劫持三架客機撞向象征美國東部經(jīng)濟和軍事象征的雙子塔,該事件被稱為9.11恐怖事件。自此之后恐怖主義犯罪大肆進入人們的視野�？植乐髁x隨著科技的發(fā)展在不斷發(fā)展,各國的應對對策也在不斷升級。美國是發(fā)達資本主義國家的代表,印度則是第三世界中的大國。雖然美印有不同的國際政治權利和利益,但兩國都面臨著嚴重的恐怖主義威脅。文章從政治、經(jīng)濟、文化和外交等方面入手,對兩國反恐怖立法的異與同進行分析。并分析兩國反恐立法在出現(xiàn)差異的原因,旨在考察兩國不同國情對立法的影響。通過研究分析美印兩國在反恐立法上的經(jīng)驗和教訓,以及我國立法上存在的問題,提出建立以反恐基本法為主導、諸法配合的反恐立法模式,遵循刑法謙抑性原則等多個建議。以期為我國反恐怖主義立法提供借鑒與參考。
[Abstract]:After the end of the Cold War, as the only superpower left, the military might of the United States was indisputable. But in September 11th 2001. Terrorists hijacked three passenger planes and crashed into twin towers that symbolize the economic and military symbols of the eastern United States. This event is called the 9 / 11 terrorist event. Since then, the crime of terrorism has entered people's field of vision. Terrorism has been developing with the development of science and technology. The United States is a representative of the developed capitalist countries, while India is a big country in the third world, although the United States is imprinted with different international political rights and interests. But both countries face a serious threat of terrorism. The article starts with political, economic, cultural and diplomatic aspects. This paper analyzes the differences and similarities of the anti-terrorism legislation between the two countries, and analyzes the reasons for the differences in the anti-terrorism legislation between the two countries. The purpose of this paper is to examine the influence of different national conditions of the two countries on the legislation. By studying and analyzing the experiences and lessons of the United States and India in anti-terrorism legislation, as well as the problems existing in the legislation of our country, the author proposes to establish the basic law on anti-terrorism as the leading factor. The legislative model of anti-terrorism coordinated by various laws follows the principle of modesty of criminal law and so on in order to provide reference and reference for our country's anti-terrorism legislation.
