【摘要】:2014年的商事登記制度改革,讓我國(guó)的行政許可監(jiān)管形式由過去的“嚴(yán)進(jìn)寬出”轉(zhuǎn)變?yōu)橐院罄m(xù)監(jiān)管為重點(diǎn)的“寬進(jìn)嚴(yán)出”的形式。行政許可后續(xù)監(jiān)管,是指行政許可主體在做出行政許可決定后對(duì)行政許可持有人所行使的監(jiān)督管理權(quán)。立法的滯后給行政監(jiān)督帶來了消極影響,重許可、輕監(jiān)管依舊是當(dāng)下行政許可執(zhí)法的現(xiàn)實(shí)情況。我國(guó)行政許可后續(xù)監(jiān)管存在的問題主要集中在以下幾方面:我國(guó)現(xiàn)有的行政體制存在職責(zé)不清、權(quán)責(zé)不一的問題,導(dǎo)致監(jiān)管不力,行政效率低下。各類行政監(jiān)督體系在運(yùn)行機(jī)制上缺乏應(yīng)有的溝通和有機(jī)的協(xié)調(diào)。缺乏有效的監(jiān)督責(zé)任機(jī)制是造成許可制度功能削弱的一個(gè)主要原因。我國(guó)目前行政監(jiān)督的有關(guān)法律比較少,有些領(lǐng)域甚至還是空白。相比較于行政監(jiān)管機(jī)關(guān)和社會(huì)公眾,行政許可持有人擁有明顯的信息優(yōu)勢(shì)。在已經(jīng)擁有信息優(yōu)勢(shì)的情況下,行政許可持有人便會(huì)對(duì)已掌握的該信息實(shí)行壟斷行為,在現(xiàn)實(shí)經(jīng)濟(jì)社會(huì)中,信息優(yōu)勢(shì)方對(duì)信息的壟斷控制正是導(dǎo)致信息不對(duì)稱的重要原因。而也正是由于這三者之間的事實(shí)信息不對(duì)稱,才導(dǎo)致了行政許可持有人的違法成本一再被削弱。本文主要從立法層面進(jìn)行分析,從立法源頭上為行政許可提供執(zhí)法依據(jù)和程序規(guī)范。同時(shí),也從制度角度對(duì)行政許可后續(xù)監(jiān)管的問題進(jìn)行總結(jié)梳理,提出將責(zé)任追究機(jī)制和信息公開制度作為解決監(jiān)管的重要手段。具體可以概括為以下幾點(diǎn):第一,學(xué)合理地設(shè)置行政許可監(jiān)管機(jī)構(gòu)體系,嚴(yán)格明晰不同職能部門的監(jiān)督重點(diǎn),避免交叉重疊的模糊檢查。第二,強(qiáng)制信息披露制度的建立能有效改善公眾的信息弱勢(shì)地位,為社會(huì)公眾參與行政許可后續(xù)監(jiān)管提供信息基礎(chǔ)條件,最終為行政許可后續(xù)監(jiān)管公眾參與機(jī)制的有效運(yùn)行提供條件與可能。第三,引入雙罰制責(zé)任制度,合理分配責(zé)任標(biāo)準(zhǔn)。雙罰制針對(duì)組織型行政許可持有人同一違法行為,對(duì)組織與個(gè)體同時(shí)實(shí)施懲戒,因此,雙罰制實(shí)現(xiàn)了組織以集體身份來承擔(dān)法律責(zé)任,違法行為個(gè)體以個(gè)體身份來獨(dú)立承擔(dān)責(zé)任的法律責(zé)任分配目標(biāo)。
[Abstract]:In 2014, the reform of commercial registration system changed the administrative license supervision form of our country from "Yan Jin out" to "lenient entry and strict exit" form. Refers to the administrative licensing subject in making administrative licensing decisions on the administrative licensing holders exercise the supervision and management power. The lag of legislation to the administrative supervision of the negative impact, re-licensing. Light supervision is still the reality of the current administrative licensing law enforcement. The problems existing in the follow-up supervision of administrative licensing in China mainly focus on the following aspects: the existing administrative system of our country has unclear responsibilities and different powers and responsibilities. Leading to poor regulation. Administrative efficiency is low. All kinds of administrative supervision system lack of proper communication and organic coordination in operation mechanism. The lack of effective supervision responsibility mechanism is one of the main reasons for weakening the function of licensing system. There are relatively few laws on administrative supervision. Some fields are even blank. Compared with the administrative regulatory authorities and the public, the holders of administrative licenses have obvious information advantages. The holders of administrative licenses will monopolize the information they already have, in the real economic society. The monopoly control of information by information advantage is the important reason that leads to information asymmetry, and it is precisely because of the fact information asymmetry between these three. The illegal cost of administrative license holders has been weakened again and again. This paper mainly analyzes from the legislative level, from the source of legislation to provide the administrative licensing law enforcement basis and procedural norms. At the same time. Also from the perspective of the system of administrative licensing follow-up regulatory issues summarized and combed, put forward the accountability mechanism and information disclosure system as an important means to solve the supervision. Specific can be summarized as the following points: first. Learn to set up a reasonable administrative licensing regulatory body system, strict clarity of different functional departments of the focus of supervision, to avoid overlapping fuzzy check. Second. The establishment of compulsory information disclosure system can effectively improve the information vulnerable position of the public, and provide the basic information conditions for the public to participate in the follow-up supervision of administrative license. Finally, it provides the conditions and possibilities for the effective operation of the public participation mechanism of administrative licensing follow-up supervision. Third, the introduction of double penalty system of liability system. The double penalty system aims at the same illegal behavior of the organizational administrative license holder and carries out the punishment on the organization and the individual at the same time. Therefore, the double penalty system realizes the organization to bear the legal responsibility in the collective capacity. The target of the distribution of the legal responsibility of the individual to bear the responsibility independently by the individual of the illegal act.
