【摘要】：我國(guó)《刑法》第一百九十八條具體規(guī)定了保險(xiǎn)詐騙罪的主體、量刑、行為方式等,這是目前我國(guó)懲治保險(xiǎn)詐騙罪的最主要法律依據(jù)。但是由于經(jīng)濟(jì)、社會(huì)的飛速發(fā)展,保險(xiǎn)詐騙的犯罪手段、犯罪對(duì)象等表現(xiàn)形式也發(fā)生了重大的變化,這就導(dǎo)致了保險(xiǎn)詐騙犯罪在司法認(rèn)定中出現(xiàn)了一些疑難問(wèn)題,例如,對(duì)于保險(xiǎn)詐騙罪幫助者行為的司法認(rèn)定問(wèn)題,以及保險(xiǎn)公司工作人員與投保人、被保險(xiǎn)人、受益人相互勾結(jié)行為的認(rèn)定問(wèn)題,在當(dāng)前司法實(shí)踐中存在很大爭(zhēng)議;另外,對(duì)于故意“帶病投�！毙袨榈恼J(rèn)定也是說(shuō)法不一。本文結(jié)合實(shí)際案例,對(duì)上述司法實(shí)踐中關(guān)于保險(xiǎn)詐騙行為疑難問(wèn)題進(jìn)行分析論證,探索相關(guān)立法的完善。
[Abstract]:Article 198 of the Criminal Law of our country specifies the subject, sentencing and behavior of the crime of insurance fraud, which is the main legal basis for punishing the crime of insurance fraud. However, due to the rapid development of economy and society, the crime means of insurance fraud, the object of crime and other forms of expression have also undergone significant changes, which has led to some difficult problems in the judicial determination of insurance fraud crime, for example, In the current judicial practice, there is a great controversy over the judicial determination of the behavior of the helper in the crime of insurance fraud, as well as the identification of the collusion between the staff of the insurance company and the insured, the insured and the beneficiary. In addition, the intentional "insurance with disease" behavior is also said to be inconsistent. Combining with practical cases, this paper analyzes and demonstrates the difficult problems of insurance fraud in judicial practice, and explores the perfection of relevant legislation.
