【摘要】：舊派、新派乃至于融合二者的人格刑法學(xué)派,對于如何貫通犯罪與刑罰內(nèi)在聯(lián)系的解析均存在問題。以對社會化的維持及其良性發(fā)展的蔑視與對抗態(tài)度作為自身內(nèi)核的主觀惡性,可以合理貫通犯罪與刑罰的內(nèi)在聯(lián)系。這個主觀惡性仍然遵循通過外在行為考察內(nèi)在意志的一般方法,犯罪行為成為其進入刑法學(xué)場域的絕對牽引力,能夠體現(xiàn)犯罪人主觀惡性的輕重程度的罪前與罪后因素,亦依附于主觀惡性進入刑法學(xué)的考察范圍。
[Abstract]:The old school, the new school and even the school of personality criminal law, have problems about how to analyze the inner relation between crime and punishment. Taking the maintenance of socialization and its benign development of contempt and antagonism as its core subjective malignancy, we can reasonably link the internal relation between crime and punishment. This subjective malignancy still follows the general method of examining internal will through external behavior. Criminal behavior becomes its absolute traction into the field of criminal law, and it can reflect the degree of subjective malignancy of the perpetrator before and after the crime. Also attached to the subjective malignant into the scope of investigation of criminal law.
