【摘要】：當(dāng)前,民營(yíng)企業(yè)家日漸成為腐敗犯罪新的高發(fā)群體,其腐敗犯罪形態(tài)多樣,危害性并不亞于公職人員的職務(wù)犯罪。導(dǎo)致民營(yíng)企業(yè)家腐敗犯罪發(fā)生的原因既有政府和市場(chǎng)邊界不清、企業(yè)自身的治理結(jié)構(gòu)不完善等客觀原因,也有對(duì)民營(yíng)企業(yè)家腐敗犯罪認(rèn)識(shí)不足、重視不夠等主觀方面的原因。建議將民營(yíng)企業(yè)家腐敗犯罪納入國(guó)家懲防腐敗體系整體格局,通過(guò)加強(qiáng)教育、建立制度、強(qiáng)化監(jiān)督等手段措施,從外部環(huán)境和企業(yè)自身兩個(gè)層面都真正形成不敢腐、不能腐、不想腐、不易腐的腐敗犯罪防范機(jī)制。
[Abstract]:At present, private entrepreneurs are becoming a new high incidence group of corruption crimes, its corruption crime forms are diverse, the harm is no less harmful than the official duty crime. The causes of the corruption crimes of private entrepreneurs are not only the unclear boundaries between the government and the market, the imperfect governance structure of the enterprises themselves, but also the subjective reasons such as insufficient understanding and insufficient attention to the corruption crimes of private entrepreneurs. It is suggested that the crime of corruption of private entrepreneurs should be brought into the overall pattern of the state system of punishing and preventing corruption. Through strengthening education, establishing system, strengthening supervision and other means, the outside environment and the enterprises themselves should be formed from the external environment and the enterprises themselves. Do not want to rot, not perishable corruption crime prevention mechanism.
