【摘要】：出土文物的買(mǎi)賣(mài)、收藏行為性質(zhì)是合法行為還是違法犯罪行為,我國(guó)的法律法規(guī)均予以了明確規(guī)定。但是,犯罪現(xiàn)象的復(fù)雜性與立法規(guī)定的缺漏性,尤其是犯罪認(rèn)定的疑難化,導(dǎo)致執(zhí)法規(guī)范的模糊性。因此,分析出土文物買(mǎi)賣(mài)、收藏執(zhí)法規(guī)范的現(xiàn)狀、辨析非法處置類(lèi)文物犯罪的立法特點(diǎn),是解決執(zhí)法困境、準(zhǔn)確認(rèn)定文物犯罪的司法保障。
[Abstract]:The sale of unearthed cultural relics, the nature of collection behavior is legal or criminal behavior, our laws and regulations are clearly stipulated. However, the complexity of criminal phenomenon and the omission of legislative provisions, especially the difficulty of criminal identification, lead to the fuzziness of law enforcement norms. Therefore, it is the judicial guarantee to analyze the sale and purchase of unearthed cultural relics, collect the present situation of law enforcement norms, and analyze the legislative characteristics of illegal disposal of cultural relics crimes, which is the judicial guarantee to solve the dilemma of law enforcement and accurately identify the crime of cultural relics.
