【摘要】：由于與判例制度具有天然的親和性,我國的刑事案例指導(dǎo)制度存在刑事指導(dǎo)性案例溯及既往效力是否存在的難題。認(rèn)為判例具有完全溯及既往的效力的觀點(diǎn),是對于判例時(shí)間效力的誤解。這種誤解導(dǎo)致上述難題始終沒有獲得足夠的重視與探討。在以美國為代表的判例法國家,判例溯及既往問題在40年間經(jīng)歷了巨大的變化。其變化的過程可以為我國刑事指導(dǎo)性案例溯及既往的問題提供借鑒�？紤]到我國的案例指導(dǎo)制度還在初創(chuàng)階段,對上述問題的探討并非急于獲得確定性的答案,而是為了通過前瞻性的建構(gòu),為司法機(jī)構(gòu)提供理論支持,防止在遇到指導(dǎo)性案例溯及既往問題時(shí),司法機(jī)關(guān)陷入不知所措的窘境。
[Abstract]:Because of its natural affinity with the precedent system, the guidance system of criminal cases has the problem of whether there is retroactivity of criminal guidance cases and whether there is any effect in the past. The view that case has full retroactive effect is a misunderstanding of its time effect. This kind of misunderstanding causes the above difficult problem to get enough attention and discussion all the time. In the case law countries represented by the United States, the issue of retroactivity has undergone great changes in 40 years. The process of change can provide reference for our country's criminal guidance cases and past problems. Considering that our country's case guidance system is still in its infancy, the discussion of the above questions is not eager to obtain definitive answers, but to provide theoretical support to the judiciary through forward-looking construction, Prevent the judiciary from getting overwhelmed when it comes to instructive cases and past problems.
