【摘要】：中國法官傾向于將"犯罪情節(jié)較輕"理解為罪行整體較輕,盡管他們在實踐中也會"自己反對自己";這表明中國法官在緩刑正當(dāng)化根據(jù)上偏好并合主義立場。法官們的再犯罪危險預(yù)測存有一定程度的偏差,裁判風(fēng)險對緩刑結(jié)果的影響遠(yuǎn)遠(yuǎn)大于再犯罪危險的影響。緩刑適用規(guī)則、裁判結(jié)果社會影響與審判責(zé)任追究的不確定性,塑造了冒險與保守并存的緩刑司法格局。要讓緩刑裁判更加科學(xué)和正義,必須為緩刑制度注入確定性。宜將"犯罪情節(jié)較輕"解釋為"(再)犯罪(危險性)情節(jié)較輕",進(jìn)而在正當(dāng)化根據(jù)上堅持分階段的并合主義立場;要通過再犯罪危險評估的科學(xué)化、定量化和專門化來提高緩刑實質(zhì)條件的操作化程度。
[Abstract]:Chinese judges tend to interpret the term "light crime" as the overall lighter crime, although in practice they will also "oppose themselves", indicating that Chinese judges prefer a meritocracy position on the basis of the justification of probation. There is a certain degree of deviation in the risk prediction of reoffending by the judges, and the influence of the judgment risk on the result of probation is far greater than that on the risk of reoffending. The applicable rules of probation, the uncertainty of the social influence of the adjudication result and the investigation of the trial responsibility have shaped the judicial pattern of both adventure and conservatism. In order to make the probation judge more scientific and just, we must inject certainty into the probation system. It is advisable to interpret the term "less criminal circumstances" as "(re) criminal (dangerous) circumstances are lighter", and then adhere to the position of amalgamation in stages on the basis of justification, and adopt the scientific assessment of the risk of re-crime. Quantitative and specialized to improve the operational level of the substantive conditions of probation.
