【摘要】：運(yùn)用經(jīng)濟(jì)思維分析刑法,為刑法問(wèn)題的解決提供了一個(gè)全新的分析視角。因此,本文通過(guò)比較法學(xué)思維與經(jīng)濟(jì)思維以及對(duì)犯罪構(gòu)成和因果關(guān)系兩方面問(wèn)題利用經(jīng)濟(jì)思維進(jìn)行擴(kuò)充性分析,從側(cè)面解讀刑法,從而更好地預(yù)防犯罪,解決犯罪,以實(shí)現(xiàn)刑法的成本減少,效益增大,使法律資源實(shí)現(xiàn)有效配置。
[Abstract]:The use of economic thinking to analyze criminal law provides a new perspective for the solution of criminal law problems. Therefore, by comparing the legal thinking with the economic thinking and using the economic thinking to expand the analysis of the constitution and causality of the crime, this paper interprets the criminal law from the side, so as to better prevent the crime and solve the crime. In order to achieve the cost reduction of criminal law, the efficiency increases, so that the effective allocation of legal resources.
