【摘要】：21世紀(jì)是個(gè)風(fēng)險(xiǎn)與機(jī)遇并存的時(shí)代,科技發(fā)展在給人類帶來進(jìn)步的同時(shí),也附帶了一些風(fēng)險(xiǎn),尤其是與人類息息相關(guān)的食品安全問題,食品安全所帶來的風(fēng)險(xiǎn)日益加劇。隨著互聯(lián)網(wǎng)技術(shù)的應(yīng)用,人們獲知信息渠道的廣泛性,更多有關(guān)食品安全的事件映入眼前,作為人類生存的基本所需,食品的安全價(jià)值已經(jīng)受到越來越多人的重視,尤其是在《食品安全法》出臺之后,刑事法律對于食品安全犯罪的規(guī)制已經(jīng)明顯滯后了,嚴(yán)密刑事法網(wǎng)的呼聲也不斷在社會(huì)中洋溢四起,我國當(dāng)前刑事法律對于食品安全犯罪的懲罰以及預(yù)防確實(shí)已經(jīng)跟隨不了時(shí)代的潮流,尤其是在進(jìn)入風(fēng)險(xiǎn)社會(huì)以后。本文以風(fēng)險(xiǎn)社會(huì)作為基點(diǎn),研究我國刑法對于有關(guān)食品安全犯罪的問題應(yīng)當(dāng)如何警醒,針對不足之處提出完善建議。具體來說,本文主要研究了以下幾個(gè)方面的內(nèi)容:首先引入了風(fēng)險(xiǎn)社會(huì)理論的概念、食品安全犯罪的相關(guān)概念,在逐漸跨入風(fēng)險(xiǎn)社會(huì)的過程中,食品安全犯罪問題成為人類生存所需考慮的重要問題,在風(fēng)險(xiǎn)社會(huì)中,刑法介入食品安全犯罪領(lǐng)域是基于不得已原則。其次,針對我國懲治有關(guān)食品安全犯罪的刑事立法進(jìn)程來講,從建國之后到1979年刑法典頒布之前,我國有關(guān)食品安全犯罪刑事立法的從無到有階段;1979年刑法典頒布之后到今天為止,我國有關(guān)食品安全犯罪刑事立法的經(jīng)歷了從“粗放”到“緊湊”的擴(kuò)張階段;在我國有關(guān)食品安全犯罪的刑事立法的進(jìn)程中,不可置否曾經(jīng)存在過各式各樣的問題,即使是如今,有關(guān)食品安全犯罪的刑事立法方面仍然存在著問題以及爭議。再次,介紹了英美法系和大陸法系關(guān)于食品安全犯罪的刑事規(guī)制問題,在此主要選取了兩大法系典型的代表國家進(jìn)行了闡述,如德國、日本、英國以及美國。他山之玉可以攻石,在分析國外先進(jìn)經(jīng)驗(yàn)的同時(shí),對于其中的優(yōu)異之處又進(jìn)行了一番解釋。第四部分主要在分析第二、三部分的基礎(chǔ)之上對于我國關(guān)于食品安全犯罪刑事法律完善思路,例如統(tǒng)一與《食品安全法》的立法邏輯,最大化維護(hù)社會(huì)正常秩序、健全刑事立法相關(guān)規(guī)定,引入超新過失理論以及抽象危險(xiǎn)犯理論,完善刑罰規(guī)定,在懲罰犯罪的時(shí)候又能夠發(fā)揮最大的預(yù)防作用。食品安全問題是民生大計(jì),是老百姓最關(guān)心的問題,當(dāng)最基本的“食”都滿足不了的話,我們對這個(gè)社會(huì)還會(huì)有什么期待呢?而刑法作為保障法,對于食品安全的作用更是不言而喻了,完善我國有關(guān)食品安全犯罪的刑事立法不僅能夠保障公民的生命、健康以及財(cái)產(chǎn)安全,更是能夠維持社會(huì)的和諧穩(wěn)定。
[Abstract]:The 21st century is an era of co-existence of risks and opportunities. The development of science and technology brings progress to human beings, but also carries some risks, especially the food safety problem, which is closely related to human beings, and the risks brought about by food safety are becoming more and more serious. With the application of Internet technology, people have been informed of the wide range of information channels, more and more food safety events are reflected in the present, as the basic needs of human survival, the value of food safety has been more and more people pay attention to. In particular, after the promulgation of the Food Safety Law, the regulation of food safety crimes by criminal law has obviously lagged behind, and the voice of the strict criminal law network has been constantly brimming with four incidents in society. The punishment and prevention of food safety crime in the current criminal law of our country can not follow the trend of the times, especially after entering the risk society. Based on the risk society, this paper studies how the criminal law of our country should be alert to the problem of food safety crime, and puts forward some perfect suggestions for the deficiency. Specifically, this paper mainly studies the following aspects: first, introduced the concept of risk society theory, food safety crime related concepts, in the process of gradually stepping into the risk society, Food safety crime has become an important issue for human survival. In a risky society, criminal law intervention in food safety crime is based on the last resort principle. Secondly, with regard to the process of criminal legislation concerning the punishment of food safety crimes in China, from the founding of the people's Republic of China to the promulgation of the Criminal Code in 1979, The criminal legislation of food safety crime in our country has been from nothing to a stage, since the promulgation of the Criminal Code in 1979 to today, the criminal legislation on food safety crime in our country has experienced an expansion stage from "extensive" to "compact". In the course of the criminal legislation on food safety crime in our country, there have been various problems in the past. Even now, there are still problems and controversies in the criminal legislation of food safety crimes. Thirdly, it introduces the criminal regulation of food safety crime in Anglo-American law system and continental law system, and mainly selects the representative countries of two major legal systems, such as Germany, Japan, Britain and the United States. The jade of his mountain can attack the stone, while analyzing the advanced experience of foreign countries, it explains the excellence of it. The fourth part is mainly based on the analysis of the second and third parts to perfect the criminal law of food safety crime in our country, such as the legislative logic of unifying and "Food Safety Law", to maximize and maintain the normal order of the society. Perfecting the relevant provisions of criminal legislation, introducing the theory of super new negligence and abstract dangerous crime, and perfecting the penalty provisions, can play the greatest preventive role in punishing the crime. Food safety is the livelihood of the people, is the people's most concerned about the issue, when the most basic "food" can not be satisfied, we will have this society will have any expectations? As a guarantee law, the criminal law plays an even more self-evident role in food safety. Perfecting the criminal legislation on food safety crimes in China can not only guarantee the life, health and property safety of citizens. It is also able to maintain social harmony and stability.
