【摘要】："預(yù)防優(yōu)于治療"的邏輯,隨著國(guó)家安全主題的不斷升溫及風(fēng)險(xiǎn)社會(huì)理論的逐步展開,日益深入人心。這種思維路徑,不僅重構(gòu)了當(dāng)下社會(huì)國(guó)家治理的模式,同時(shí)亦形塑了刑法范式的轉(zhuǎn)變軌跡。對(duì)"預(yù)防"這一術(shù)語(yǔ)的進(jìn)一步詮釋與厘定,不僅關(guān)涉國(guó)家職能在"人人自危"的場(chǎng)景中如何進(jìn)行解讀,另關(guān)涉例外主義的理論如何對(duì)社會(huì)公共生活領(lǐng)域進(jìn)行滲透,關(guān)涉國(guó)家安全對(duì)后現(xiàn)代社會(huì)的刑法范式如何進(jìn)行遷轉(zhuǎn),關(guān)涉作為社會(huì)治理工具之一的刑法應(yīng)恪守哪些原則和底線。
[Abstract]:The logic of "prevention is better than treatment", with the rising of national security theme and the gradual development of the theory of risk society, it is becoming more and more popular.This way of thinking not only reconstructs the current mode of state governance, but also shapes the changing track of the paradigm of criminal law.The further interpretation and determination of the term "prevention" concerns not only how the functions of the state are interpreted in the scene of "self-care", but also how the theory of exceptionalism infiltrates the field of social public life.The national security is concerned with how to transfer the criminal law paradigm of the post-modern society and which principles and bottom line should be observed by the criminal law as one of the tools of social governance.
