【摘要】：隨著社會的發(fā)展,我國的黑社會性質(zhì)組織犯罪日趨嚴重,對社會的危害性也在逐步升級。因此,有效遏制和打擊黑社會性質(zhì)組織犯罪成為了一個刻不容緩的社會問題。但是,我國刑法中關于黑社會性質(zhì)組織的特征的規(guī)定卻不甚明了,使得在司法實踐中認定、打擊、懲治黑社會性質(zhì)組織存在困難。本文采用歷史分析、比較分析、理論分析的方法,先對我國黑社會性質(zhì)組織犯罪的演變和立法發(fā)展、域外黑社會組織犯罪的立法進行比較,然后又對我國黑社會性質(zhì)組織的特征進行系統(tǒng)分析,并指出其立法上的不足,進而提出完善相關立法的建議。論文內(nèi)容主要分為五個部分,共三萬余字：第一部分是導論,闡明選題的背景和意義以及研究的方法；第二部分對域外黑社會組織犯罪和我國黑社會性質(zhì)組織犯罪的立法進行比較研究,通過比較,可以對域外科學合理的立法予以借鑒；第三部分對我國黑社會性質(zhì)組織的特征進行深入細致的分析；第四部分在第三部分分析的基礎上,指出在立法上的缺陷并提出完善的建議；第五部分是結語,對本文寫作的內(nèi)容進行總結,并指研究該課題的意義。
[Abstract]:With the development of society, the organized crime of underworld in our country is becoming more and more serious, and the harmfulness to the society is being escalated step by step.Therefore, it has become an urgent social problem to effectively curb and crack down on the organized crime of underworld nature.However, the characteristics of underworld organizations in the criminal law of our country are not clear, which makes it difficult to crack down and punish the underworld organizations in judicial practice.This article uses the historical analysis, the comparative analysis, the theory analysis method, first carries on the comparison to our country underworld nature organization crime evolution and the legislation development, the extraterritorial underworld organization crime legislation.Then the characteristics of China's underworld organizations are systematically analyzed, and the shortcomings of their legislation are pointed out, and suggestions for perfecting the relevant legislation are put forward.The paper is divided into five parts, a total of more than 30, 000 words: the first part is an introduction to clarify the background and significance of the topic and research methods;The second part makes a comparative study on the legislation of the extra-territorial gangland organization crime and our country's underworld organization crime. Through the comparison, we can draw lessons from the extraterritorial scientific and reasonable legislation.The third part makes a thorough and detailed analysis of the characteristics of the underworld organization in our country; the fourth part points out the defects in the legislation and puts forward some perfect suggestions on the basis of the third part; the fifth part is the conclusion.This paper summarizes the content of the writing, and refers to the significance of the study of the subject.
