【摘要】：本文對(duì)擴(kuò)張解釋與類推解釋的關(guān)系進(jìn)行了研究。論文分為四個(gè)部分,第一部分對(duì)學(xué)界關(guān)于擴(kuò)張解釋和類推解釋的爭(zhēng)論進(jìn)行了總結(jié)和分析;第二部分對(duì)擴(kuò)張解釋、類推解釋以及其他相關(guān)概念重新進(jìn)行了界定,厘清了其各自的含義。擴(kuò)張解釋與類推解釋同屬于法律解釋,類推解釋是法律解釋理由中的一種,而擴(kuò)張解釋是對(duì)解釋結(jié)論的分析,類推解釋的解釋結(jié)論可以是擴(kuò)張解釋,也可能是縮小解釋或者平義解釋;第三部分提出論文的觀點(diǎn),指出擴(kuò)張解釋和類推解釋爭(zhēng)論的根源是學(xué)者們對(duì)刑法解釋界限的誤解。確定刑法解釋界限的關(guān)鍵不在于對(duì)擴(kuò)張解釋和類推解釋的區(qū)分,而必須回到刑法解釋的問(wèn)題本身,作者分析了中國(guó)和德國(guó)關(guān)于罪刑法定原則的理解與實(shí)踐,從文字學(xué)視角對(duì)刑法解釋“可能的文義”進(jìn)行了補(bǔ)充,提出可以通過(guò)對(duì)文字含義的引申來(lái)填補(bǔ)法律漏洞;第四部分通過(guò)對(duì)涉及擴(kuò)張解釋與類推解釋關(guān)系的若干實(shí)際問(wèn)題進(jìn)行分析,進(jìn)一步闡述了作者的主張。
[Abstract]:The thesis is divided into four parts. The first part summarizes and analyzes the debate about expansion interpretation and analogy interpretation in academic circles, the second part is about expansion interpretation. Analogy interpretation and other related concepts are redefined to clarify their respective meanings. Expansion interpretation and analogy interpretation belong to legal interpretation. Analogy interpretation is one of the reasons for legal interpretation. The expansion interpretation is the analysis of the interpretation conclusion, and the conclusion of the analogy interpretation can be the expansion explanation, or the narrow interpretation or the even-meaning explanation. The third part puts forward the viewpoint of the thesis. It is pointed out that the root of the controversy between expansion interpretation and analogy interpretation is the misunderstanding of the limits of criminal law interpretation by scholars. The key to determining the limits of criminal law interpretation lies not in the distinction between expansion interpretation and analogy interpretation, but in returning to the problem of criminal interpretation itself. The author analyzes the understanding and practice of the principle of legality in China and Germany, supplements the interpretation of "possible meaning" of criminal law from the perspective of philology, and puts forward that the legal loophole can be filled by the extension of the meaning of writing. In the fourth part, the author's opinion is further expounded through the analysis of some practical problems concerning the relationship between expansion interpretation and analogy interpretation.
