【摘要】：刑法公眾認同,是指一國刑法時空效力所及范圍內(nèi)的大多數(shù)人即公眾對刑法規(guī)范及其實踐運行的正當(dāng)性和效力性等的認可與贊同。主體廣布性、社會共識性和相對穩(wěn)定性分別構(gòu)成了刑法公眾認同的主體性特征、價值性特征和存在性特征,而且這些特征相輔相成和相互說明,刑法公眾認同之本質(zhì)即"價值共同"。通過型構(gòu)對話型刑事話語系統(tǒng)、響應(yīng)共治型社會管理模式和加強對刑法的信仰,刑法公眾認同就會突顯其在當(dāng)下的重要實踐意義。
[Abstract]:Public recognition of criminal law refers to the recognition and approval of the legitimacy and validity of the norms of criminal law and its practice by most people within the scope of the space-time validity of criminal law in a country. The social consensus and relative stability constitute the subjective characteristics, the value characteristics and the existential characteristics of the public identity of criminal law respectively, and these characteristics complement each other and explain each other. The essence of the public identity of criminal law is "common value". The public identity of criminal law will highlight its important practical significance in the present time by constructing a discourse system of criminal law, responding to the model of co-governing social management and strengthening the belief in criminal law.
