【摘要】：《刑法》第196條所規(guī)定的"冒用他人信用卡",是指行為人假冒合法持卡人的名義使用信用卡(含借記卡)的行為。其中的"信用卡"僅限于他人真實有效的信用卡,而不包括他人已經(jīng)作廢的信用卡�；贏TM機等機器的工作原理可知,機器在銀行卡業(yè)務(wù)中實際上處于輔助者的地位,它反映并執(zhí)行銀行的意志,其本身雖然不能被騙,但行為人能夠通過機器實現(xiàn)對銀行工作人員的欺騙。對于"盜竊信用卡并使用"的行為,不應(yīng)限定為僅對自然人使用,而應(yīng)該包括對ATM機等機器使用。對于侵占、搶劫、搶奪、敲詐勒索他人信用卡后又使用的情形,應(yīng)當(dāng)按照牽連犯的處斷原則,以其中較重的犯罪定罪處罰。行為人采用詐騙的方式取得他人信用卡,并采用詐騙的方式取得合法持卡人的同意或者授權(quán),進而使用該信用卡的,其實質(zhì)仍屬于違背合法持卡人意志的"冒用"行為,應(yīng)當(dāng)認定為信用卡詐騙罪。
