【摘要】：犯罪主觀要件的證明是刑事司法實(shí)踐中的一個(gè)難題。本文在深入探討犯罪主觀要件與客觀行為間的聯(lián)系的基礎(chǔ)上，提出犯罪主觀要件證明存在直接認(rèn)定、演繹推理、推論、推定以及法律擬制幾種方法，文中對(duì)推論與推定進(jìn)行了區(qū)分，對(duì)涉及的證明責(zé)任與證明標(biāo)準(zhǔn)問題進(jìn)行了闡述。本文最后探討了“明知”與“非法占有目的”的證明，，辨析了相關(guān)司法解釋的規(guī)定。本文意義在于為實(shí)踐中犯罪主觀要件的證明提供些許理論上的指導(dǎo)。
[Abstract]:The proof of the subjective elements of a crime is a difficult problem in the practice of criminal justice. On the basis of deeply discussing the relationship between the subjective elements of a crime and the objective acts, this paper puts forward that the proof of the subjective elements of a crime has direct identification, deductive reasoning, and corollary. In this paper, the author distinguishes the inference from the presumption, expounds the burden of proof and the standard of proof. Finally, the paper discusses the proof of "knowing" and "the purpose of illegal possession". The significance of this paper is to provide some theoretical guidance for the proof of subjective elements of crime in practice.
