【摘要】：十八屆五中全會(huì)以來,中央政府與社會(huì)各界對(duì)于“三農(nóng)”的問題給予了高度的關(guān)注,尤其是在扶貧領(lǐng)域,政府部門推出了不同的扶貧政策,開展了不同的扶貧項(xiàng)目,國家財(cái)政部門對(duì)于我國的扶貧工作給予了大量的資金支持。在改善貧困群眾的生活條件、在提高貧困地區(qū)經(jīng)濟(jì)發(fā)展方面取得顯著的成就,但是在扶貧資金的監(jiān)管、扶貧項(xiàng)目的實(shí)施方面也出現(xiàn)了一系列的問題,扶貧領(lǐng)域的部分的工作人員,為了個(gè)人的私利與欲望,無視個(gè)人職責(zé)與道德底線,無視國家的法律,無視人民的相關(guān)利益,對(duì)扶貧資金進(jìn)行虛報(bào)、冒領(lǐng)等,有的還收受賄賂,玩忽職守。扶貧領(lǐng)域職務(wù)犯罪使國家有關(guān)扶貧的政策和措施達(dá)不到預(yù)期中的效果和成效,扶貧領(lǐng)域的職務(wù)犯罪的多發(fā)與高發(fā)不僅嚴(yán)重侵害了農(nóng)民群眾的切身利益,造成了農(nóng)民群眾的貧困情況沒有得到相應(yīng)的改善,極易引起農(nóng)村各種社會(huì)矛盾的激化,而且破壞了政府部門的誠信形象,已經(jīng)成為制約農(nóng)村社會(huì)穩(wěn)定、和諧發(fā)展的重要因素。根據(jù)各級(jí)檢察機(jī)關(guān)發(fā)布的有關(guān)職務(wù)犯罪的信息,可以明顯的看到我國職務(wù)犯罪案件逐年遞增,扶貧領(lǐng)域的職務(wù)犯罪也不斷發(fā)生,2016年10月十八屆六中全會(huì)表明將會(huì)對(duì)于貪污腐敗進(jìn)行嚴(yán)厲的懲治,通過采取相應(yīng)的措施來預(yù)防職務(wù)犯罪,維護(hù)人民群眾的切身利益。扶貧領(lǐng)域職務(wù)犯罪的防治研究,首先我們應(yīng)該對(duì)于扶貧領(lǐng)域、職務(wù)犯罪、職務(wù)犯罪預(yù)防等相關(guān)概念進(jìn)行界定,并對(duì)這些概念有一個(gè)清晰的了解與認(rèn)識(shí),是對(duì)本文進(jìn)行展開的前提條件。其次,通過對(duì)扶貧領(lǐng)域職務(wù)犯罪的現(xiàn)狀的研究與分析,總結(jié)我國扶貧領(lǐng)域職務(wù)犯罪的特點(diǎn),如犯罪主體集中、犯罪罪名集中、職務(wù)犯罪發(fā)生環(huán)節(jié)集中、作案手段多樣、窩串案較多、共同犯罪案件占較大比例。然后,通過對(duì)現(xiàn)狀的分析,發(fā)現(xiàn)扶貧領(lǐng)域相關(guān)制度存在的問題,找到扶貧領(lǐng)域職務(wù)犯罪頻發(fā)的原因,如扶貧領(lǐng)域資金管理方面存在不足、監(jiān)督體系不健全、部分扶貧工作人員的綜合素養(yǎng)較低、法律意識(shí)淡薄、針對(duì)職務(wù)犯罪的打擊力度不大。最終,本文針對(duì)扶貧領(lǐng)域職務(wù)犯罪產(chǎn)生的原因提出相應(yīng)的防治建議,如完善與落實(shí)政務(wù)、村務(wù)的信息公開制度、改善扶貧資金管理方式、建立健全的扶貧監(jiān)督機(jī)制、提高扶貧人員的綜合素養(yǎng)、加大對(duì)職務(wù)犯罪的打擊力度。
[Abstract]:Since the Fifth Plenary session of the 18th CPC Central Committee, the central government and various sectors of society have paid high attention to the issue of "agriculture, countryside and farmers," especially in the field of poverty alleviation. Government departments have launched different poverty alleviation policies and launched different poverty alleviation projects. The state financial department has given a large amount of financial support to poverty alleviation in our country. It has made remarkable achievements in improving the living conditions of the poor people and in improving the economic development of poverty-stricken areas, but in the supervision of poverty alleviation funds, There have also been a series of problems in the implementation of poverty alleviation projects. Some of the staff in the field of poverty alleviation have ignored their personal interests and desires, their personal duties and moral bottom lines, the laws of the country and the relevant interests of the people. Making false reports on poverty alleviation funds, taking false claims, and some accepting bribes and dereliction of duty. As a result of job-related crimes in the field of poverty alleviation, the state policies and measures on poverty alleviation have failed to achieve the expected results and results. The frequent and high incidence of job-related crimes in the field of poverty alleviation not only seriously infringes on the vital interests of the peasants, but also results in a situation of poverty among the peasants that has not been correspondingly improved, and which can easily lead to the intensification of various social contradictions in the rural areas. Moreover, it has destroyed the integrity image of government departments and has become an important factor restricting the stability and harmonious development of rural society. According to the information on job-related crimes issued by procuratorial organs at all levels, We can clearly see that the number of job-related crimes in China is increasing year by year, and that job-related crimes in the field of poverty alleviation are also occurring. In October 2016, the sixth Plenary session of the 18th Central Committee of the CPC Central Committee indicated that corruption and corruption will be severely punished. By taking appropriate measures to prevent job-related crimes, to safeguard the vital interests of the people, and to study the prevention and control of job-related crimes in the field of poverty alleviation, we should first define related concepts such as poverty alleviation, job-related crimes, and prevention of job-related crimes. And have a clear understanding and understanding of these concepts, which is the premise of this paper. Secondly, through the research and analysis of the present situation of duty crime in the field of poverty alleviation, this paper summarizes the characteristics of the crime in the field of poverty alleviation. For example, the main body of the crime is concentrated, the crime charge is concentrated, the occurrence of duty crime is concentrated, the means of committing the crime are various, there are many common crimes, and the joint crime cases account for a large proportion. Then, through the analysis of the present situation, Find out the problems existing in the relevant systems in the field of poverty alleviation, and find out the reasons for the frequent occurrence of job-related crimes in the field of poverty alleviation, such as insufficient fund management in the field of poverty alleviation, imperfect supervisory system, and low comprehensive literacy of some staff working in poverty alleviation. The legal consciousness is weak and the crackdown on job-related crimes is not strong. Finally, this paper puts forward corresponding prevention and cure suggestions for the causes of job-related crimes in the field of poverty alleviation, such as perfecting and implementing government affairs and the information disclosure system of village affairs, To improve the management of poverty alleviation funds, to establish and improve the supervision mechanism of poverty alleviation, to improve the comprehensive quality of poverty alleviation personnel, and to intensify the crackdown on job-related crimes.
