【摘要】：由于刑法規(guī)定的非刑罰處罰措施在適用方式與內(nèi)容上均有一定的局限性,因而司法實(shí)踐中在對(duì)行賄犯罪人免于刑事處罰時(shí)較少采用非刑罰處罰措施,由此導(dǎo)致免于刑事處罰的行賄犯罪人實(shí)際上未受到任何處罰和教訓(xùn)。雖然《刑法修正案(九)》在一定程度上縮小了對(duì)行賄罪免除處罰的范圍,但基于查處與打擊受賄犯罪的需要,司法實(shí)踐中仍不可避免因"辯訴交易"而對(duì)行賄犯罪免除處罰。因此,為有效懲治與預(yù)防行賄犯罪進(jìn)而有效遏制受賄犯罪,有必要對(duì)行賄犯罪非刑罰處罰措施的適用進(jìn)行一定程度的規(guī)范與完善。對(duì)于行賄犯罪人能夠產(chǎn)生預(yù)防犯罪作用的訓(xùn)誡、責(zé)令具結(jié)悔過、建議主管部門予以行政處罰或者行政處分這三種非刑罰處罰措施,無論在形式上抑或內(nèi)容上,均因或多或少存在一定的局限性而應(yīng)當(dāng)進(jìn)行規(guī)范。此外,對(duì)行賄犯罪非刑罰處罰措施的規(guī)范適用,還必須輔之以相對(duì)完備的基礎(chǔ)制度,因此,應(yīng)當(dāng)夯實(shí)行賄犯罪非刑罰處罰的司法基礎(chǔ),完善信息及時(shí)披露制度和相應(yīng)的監(jiān)督機(jī)制,以及構(gòu)建行賄單位強(qiáng)制性檢察監(jiān)管制度等。
[Abstract]:The provisions of the criminal law and non penalty measures in the application of methods and contents are limited, so in judicial practice of bribery crime from criminal punishment when using less non penalty measures, resulting from criminal punishment of bribery crime in fact did not suffer any punishment and lessons. Although the criminal law amendment (nine < >) to a certain extent reduced the scope of the crime of bribery punishment, but based on the investigation and the need to combat the crime of bribery, is inevitable in judicial practice because of "plea bargaining" and crime of offering bribes, exempted from punishment. Therefore, to effectively punish and prevent the crime of bribery and bribery crime effectively, it is necessary to apply bribery the crime of non penalty punishment measures and improve certain regulations. For the crime of bribery crime prevention effect of people can produce the reprimand, ordered to make a statement of repentance, recommended that the competent The Department of administrative punishment or administrative action of these three kinds of non penalty measures, either in form or content, are more or less because of some limitations and should be standardized. In addition, for the bribery crime of non penalty punishment measures norms, must be accompanied by a relatively complete system of the foundation, therefore, should the judicial lay a solid foundation for the bribery crime of non punishment, perfecting the information disclosure system and the corresponding supervision mechanism, and the construction of procuratorial supervision system of bribery units mandatory.
