【摘要】：拐賣兒童犯罪是近年來高發(fā)的犯罪之一,對(duì)于因孩子被拐而失去孩子的父母甚至整個(gè)家族而言就是晴天霹靂。近年來,理論界也掀起了一股研究拐賣兒童罪的風(fēng)潮。本文通過對(duì)民眾關(guān)注度較高的相關(guān)社會(huì)熱門事件的探討,諸如當(dāng)時(shí)在微信朋友圈里刷屏的“拐賣兒童一律判死”的話題,來了解拐賣兒童罪背后的一些實(shí)質(zhì)問題。社會(huì)成員在關(guān)心生活中屢禁不止的拐賣兒童的行為時(shí),需要理性,不能盲目地認(rèn)為一律判死就能永絕后患。本人從理論界和實(shí)務(wù)界兩個(gè)方面分析本罪在立法層面存在的缺陷,并大膽地對(duì)本罪的法定刑提出質(zhì)疑,希望取消本罪死刑設(shè)置,并對(duì)出賣親生子女行為和“代孕”行為進(jìn)行一番探討,這一點(diǎn)在以往的研究中是少見的。本文試圖以這樣的視角,全面剖析本罪,以期能對(duì)本罪的完善方面提供借鑒。本文將從以下四個(gè)維度對(duì)拐賣兒童罪加以論述:第一部分主要從概念的維度對(duì)拐賣兒童進(jìn)行剖析。首先論述拐賣的概念、兒童的含義,在此基礎(chǔ)上總結(jié)出拐賣兒童罪的概念。其次從兒童自身權(quán)益,兒童監(jiān)護(hù)人監(jiān)護(hù)權(quán)以及社會(huì)秩序這三個(gè)方面探討拐賣兒童法律規(guī)制的必要性。最后簡要論述域外立法中對(duì)于拐賣兒童罪的規(guī)定,以期對(duì)我國拐賣兒童犯罪的立法完善提供借鑒。第二部分主要闡述我國關(guān)于拐賣兒童罪的立法現(xiàn)狀。通過分析該罪犯罪構(gòu)成,了解本罪的客體、客觀方面、主體以及主觀方面等構(gòu)成要素。其次,分析本罪在刑法上的規(guī)定,以及相關(guān)司法解釋的規(guī)定,為接下來本罪的缺陷及完善的論述埋下伏筆。第三部分從三個(gè)方面分析本罪在立法層面存在的缺陷,即從本罪的犯罪對(duì)象、主觀方面、法定刑設(shè)置這三個(gè)方面展開分析,并且多數(shù)是以案例分析的視角引入,這樣更便于在實(shí)踐中對(duì)拐賣兒童罪有一個(gè)直觀深入的了解。第四部分是本文的重要部分,主要是對(duì)第三部分存在的立法層面的缺陷提出筆者認(rèn)為切實(shí)可行的立法建議。也是從三個(gè)方面,即犯罪對(duì)象、主觀方面、法定刑設(shè)置,針對(duì)每一個(gè)存在的立法缺陷,通過查找各方資料,加之本人對(duì)立法方面的大膽構(gòu)想,提出立法建議。
[Abstract]:The crime of child abduction is one of the most common crimes in recent years. It is a bolt from the blue for parents who have lost their children because their children have been abducted, and for the whole family. The theoretical circle has also set off a wave of research on the crime of child abduction and trafficking. This paper discusses relevant social hot events with a high degree of public concern, such as the topic of "Child abduction and sale all sentenced to death", which was scrubbed in Moments on WeChat at that time. To understand some of the real issues behind the crime of child abduction and trafficking. Members of society need to be rational when they are concerned about the repeated practice of child abduction and trafficking in their daily lives. I can't blindly think that the death sentence can never end the future. I analyze the defects of the crime in the legislative level from the theoretical and practical aspects, and boldly challenge the statutory punishment of this crime, hoping to abolish the establishment of the death penalty for this crime. It is rare to discuss the behavior of selling out biological children and "surrogate pregnancy" in the past. This article tries to analyze the crime from this angle of view. This article will discuss the crime of trafficking in children from the following four dimensions: the first part mainly analyzes the concept of trafficking in children from the dimensions of the concept. First, discusses the concept of trafficking, the meaning of children, On this basis, the concept of the crime of abduction and trafficking of children is summarized. Secondly, from the perspective of children's own rights and interests, This paper discusses the necessity of the legal regulation of child trafficking from the three aspects of custody of child guardian and social order. Finally, it briefly discusses the provisions of the extraterritorial legislation on the crime of trafficking in children. The second part mainly expounds the current situation of legislation on the crime of trafficking in children in our country. By analyzing the constitution of the crime, we can understand the object and objective aspects of the crime. Secondly, it analyzes the provisions of this crime in the criminal law, as well as the relevant provisions of judicial interpretation. The third part analyzes the defects of the crime in the legislative level from three aspects, that is, from the object of the crime, subjective aspects, legal penalty set these three aspects of analysis. And most of them are introduced from the perspective of case analysis, so it is more convenient to have an intuitive and in-depth understanding of the crime of trafficking in children in practice. Part 4th is an important part of this article. The main part of the third part of the legislative level of the defects of the author think feasible legislative recommendations. Also from three aspects, namely, the object of crime, subjective aspects, legal penalty settings, in view of each of the legislative defects, By looking up all kinds of information, plus my bold ideas on legislation, put forward legislative suggestions.
