【摘要】：刑法是關(guān)于犯罪和刑罰的法律規(guī)定,其中刑期是刑罰的重要內(nèi)容。但刑法及刑法學(xué)對(duì)憑什么規(guī)定"犯X罪判處Y年"并沒(méi)有給出令人信服的根據(jù)和理由。時(shí)間的性質(zhì)決定了時(shí)間可以成為刑罰的手段,具體表現(xiàn)就是刑期。刑期應(yīng)根據(jù)經(jīng)濟(jì)、政治、社會(huì)和文化等因素去規(guī)定,尤其應(yīng)根據(jù)不同國(guó)家不同時(shí)期的社會(huì)必要?jiǎng)趧?dòng)時(shí)間來(lái)規(guī)定,具體包括犯罪類型、犯罪情節(jié)、犯罪結(jié)果、社會(huì)危害性、犯罪成本、刑罰價(jià)值觀、司法實(shí)踐、改造罪犯的時(shí)間、賠償被害人損失的時(shí)間等因素來(lái)規(guī)定。此外,刑期應(yīng)該遵循罪刑相當(dāng)、刑罰公平、刑罰效率等原則。為此,要致力于建立一門"時(shí)間刑罰學(xué)"或"刑期學(xué)"乃至"數(shù)理刑法學(xué)",只有這樣才能使刑法成為"最精確的刑法學(xué)"。
[Abstract]:Criminal law is a legal provision on crime and punishment. Among them, the term of imprisonment is an important part of the penalty. But the criminal law and the criminal law on what basis "X crime sentence Y years" The nature of time determines that time can be used as a means of punishment. The term of imprisonment should be defined according to economic, political, social and cultural factors, especially according to the necessary time of social labor in different countries, including the type of crime. The circumstances of the crime, the result of the crime, the social harmfulness, the cost of the crime, the value of penalty, the judicial practice, the time of reforming the criminal, the time of compensating the victim and so on. The term of imprisonment should follow the principles of equal crime and punishment, fair penalty, penalty efficiency and so on. To this end, we should devote ourselves to establishing a discipline of "time penalty" or "term of imprisonment" or even "mathematical criminal law". Only in this way can criminal law become the most accurate criminal law.
