【摘要】：正西方憲政模式本身存在諸多弊端,即使對于西方國家自身,這種模式也不是十全十美的,我們堅決不走西方憲政之路在過去一年關于憲政的爭論中,有三種基于不同理論認知的憲政主張:第一種主張是堅定地走中國特色憲政之路,該主張所基于的是憲政的普遍適用性與中國國情特殊性相結合的理論認知;第二種主張是走與西方國家完全相同的憲政之路,該主張所基于的是西方憲政為唯一普適性憲政模式,憲政即西方憲政的理論認知;第三種主張是拒絕和反對任何憲政,繼續(xù)走我們已經(jīng)走
[Abstract]:There are many drawbacks in the western constitutional model itself, even for the western countries themselves, this model is not perfect, we firmly do not take the road of Western constitutional government in the past year on the constitutional debate, there are three kinds of constitutional ideas based on different theoretical cognition: the first is firmly to take the road of constitutional government with Chinese characteristics, this is not perfect. The proposition is based on the theoretical cognition of the universality of constitutionalism and the particularity of China's national conditions; the second proposition is to follow the same path of constitutionalism as that of Western countries. The proposition is based on the theoretical cognition that western constitutionalism is the only universality of constitutionalism, and that constitutionalism is western constitutionalism; the third proposition is to reject and oppose the responsibility.
