行政訴訟電子化的根源闡釋與蘊涵剖析——兼論行政訴訟法的應對

【摘要】：行政訴訟作為化解行政糾紛的重要途徑和最后防線,其與代表著高效的互聯(lián)網(wǎng)技術(shù)的交融不可避免。行政訴訟電子化是行政訴訟的內(nèi)在需求,是應對電子政務浪潮與電子行政行為沖擊的應有之義。在實踐中,電子民事訴訟已取得令人矚目的發(fā)展。與解決平等主體間糾紛的民事訴訟不同,行政訴訟電子化應謹慎前行,電子行政訴訟的建立應循序漸進,可由地方先試先行,最終以修改法律文本的形式予以確認。
[Abstract]:As an important way to resolve administrative disputes and the final defense line, administrative litigation is inevitable with the efficient Internet technology. The electronicization of administrative litigation is the inner demand of administrative litigation, and it is due meaning to deal with the wave of e-government and the impact of electronic administrative act. In practice, electronic civil litigation has achieved remarkable development. Unlike the civil litigation to solve the dispute between equal subjects, the electronic process of administrative litigation should proceed with caution, and the establishment of electronic administrative litigation should be gradual, which can be confirmed in the form of modifying the legal text.
