【摘要】：在闡述林業(yè)行政公益訴訟的概念、特征和作用的基礎(chǔ)上,指出林業(yè)行政公益訴訟的原告資格應(yīng)擴展至檢察機關(guān)和社會組織,并對社會組織作出限制性規(guī)定;受案范圍還應(yīng)包括規(guī)章以下的抽象行政行為。對林業(yè)行政公益訴訟需要解決的具體問題包括訴前程序的設(shè)置、舉證責(zé)任的分配、行政不作為的認(rèn)定及其法律責(zé)任形式等進行深入分析。最后對林業(yè)行政公益訴訟立法提出了具體建議。
[Abstract]:On the basis of expounding the concept, characteristics and functions of forestry administrative public interest litigation, this paper points out that the plaintiff qualification of forestry administrative public interest litigation should be extended to procuratorial organs and social organizations, and make restrictive provisions on social organizations, and the scope of accepting cases should also include abstract administrative acts below regulations. This paper analyzes the specific problems to be solved in forestry administrative public interest litigation, including the establishment of pre-litigation procedure, the distribution of burden of proof, the identification of administrative omission and the form of legal liability. Finally, the paper puts forward some concrete suggestions on the legislation of forestry administrative public interest litigation.
