【摘要】：正修改后刑訴法第九十三條賦予檢察機(jī)關(guān)對(duì)逮捕后犯罪嫌疑人、被告人的羈押狀況進(jìn)行必要性審查的權(quán)力,這是一項(xiàng)全新的檢察制度,也是一項(xiàng)全新的檢察監(jiān)督職權(quán)。山東省煙臺(tái)市芝罘區(qū)人民檢察院在開展羈押必要性審查工作過程中,逐步探索以偵監(jiān)、公訴、監(jiān)所檢察部門的聯(lián)動(dòng)為基礎(chǔ),以捕后偵查、審查起訴階段為環(huán)節(jié),監(jiān)所檢察部門全程監(jiān)督為保障的實(shí)踐做法,稱為"芝罘模式"。一、"芝罘模式"的特點(diǎn)。"芝罘模式"作為解決實(shí)踐中羈押?jiǎn)栴}而產(chǎn)生的工作機(jī)制,尤其是對(duì)解決普遍存在的羈押率過高、一押到底,甚至刑罰倒掛等問題,具有較大的現(xiàn)實(shí)意
[Abstract]:Article 93 of the revised Criminal procedure Law gives the procuratorial organs the power to examine the necessity of the detention of suspects and defendants after arrest, which is a new procuratorial system and a new procuratorial supervision authority. In the process of examining the necessity of detention, the people's Procuratorate of Zhifu District, Yantai City, Shandong Province, has gradually explored the linkage between investigation and supervision, public prosecution, and procuratorial departments of the prison, taking the stage of post-arrest investigation and examination and prosecution as the link. The practice that the procuratorial department of the institute supervises the whole course is called "Zhifu mode". First, the characteristics of the "Zhifu model". " As a working mechanism to solve the problem of detaining in practice, Zhifu mode has a great realistic meaning to solve the problems such as the high rate of custody, the problem of detaining in the end, and even the upside down of punishment, etc.
