【摘要】：在刑事訴訟領(lǐng)域內(nèi),非法證據(jù)排除規(guī)則無疑是最重要的證據(jù)規(guī)則。對我國初步建立的非法證據(jù)排除規(guī)則進行進一步完善,是我國司法改革民主化、人權(quán)化的必然要求。本文分為四個部分對非法證據(jù)排除規(guī)則及其在審查逮捕階段的適用進行研究,探索非法證據(jù)排除規(guī)則的起源及其在我國發(fā)展,研究非法證據(jù)排除規(guī)則的內(nèi)涵與外延,分析國外非法證據(jù)排除規(guī)則的立法實踐,從立法和司法實踐的角度剖析我國非法證據(jù)排除規(guī)則的經(jīng)驗與不足,及其在審查逮捕階段存在的主要問題,對完善我國非法證據(jù)排除規(guī)則在審查逮捕階段的適用提出措施和建議。第一部分從基本概念入手,分析非法證據(jù)排除規(guī)則的發(fā)生、發(fā)展。本文分析了非法證據(jù)排除規(guī)則的內(nèi)涵和外延,通過比較英美、大陸兩大法系的非法證據(jù)排除規(guī)則,探尋其發(fā)展規(guī)律,通過分析我國現(xiàn)價段的社會現(xiàn)狀,探討我國建立和完善非法證據(jù)規(guī)則的必要性。第二部分分析我國非法證據(jù)排除規(guī)則的立法現(xiàn)狀,針對我國初步確立的非法證據(jù)排除規(guī)則特別是五部委聯(lián)合頒布的兩個證據(jù)規(guī)定和新修訂的刑事訴訟法,分析、探討現(xiàn)價段我國非法證據(jù)排除規(guī)則的表現(xiàn)形式、特點及其在立法方面的不足和司法實踐中的現(xiàn)實困難。第三部分從分析非法證據(jù)排除與審查逮捕工作的關(guān)系出發(fā),查找審查逮捕階段偵查監(jiān)督部門適用非法證據(jù)排除規(guī)則面臨的現(xiàn)實問題。第四部分針對我國法律對在審查逮捕階段適用非法證據(jù)排除規(guī)則規(guī)定上的缺失,對在審查逮捕階段適用非法證據(jù)排除規(guī)則提出措施和建議,結(jié)合審查逮捕工作實踐,提出并論證確立證明標準、完善啟動程序、明確排除效力以及證據(jù)補正方面的建議。這是本文的重點與難點。
[Abstract]:In the field of criminal procedure, the rule of illegal evidence exclusion is undoubtedly the most important rule of evidence. It is an inevitable requirement for the democratization and human rights of judicial reform to further improve the rule of exclusion of illegal evidence initially established in our country. This article is divided into four parts to study the exclusionary rule of illegal evidence and its application in the stage of examination and arrest, to explore the origin and development of the rule of exclusion of illegal evidence in China, and to study the connotation and extension of the rule of exclusion of illegal evidence. This paper analyzes the legislative practice of the exclusionary rules of illegal evidence in foreign countries, analyzes the experiences and shortcomings of the exclusionary rules of illegal evidence in our country from the angle of legislative and judicial practice, and the main problems existing in the stage of examining and arresting illegal evidence. Some measures and suggestions are put forward to perfect the application of the exclusionary rule of illegal evidence in the stage of examination and arrest. The first part starts with the basic concept and analyzes the occurrence and development of illegal evidence exclusion rules. This paper analyzes the connotation and extension of illegal evidence exclusion rules. By comparing the illegal evidence exclusion rules between the United States and the two major civil law systems, this paper explores its development rules, and analyzes the current social situation of the current price section in China. This paper discusses the necessity of establishing and perfecting illegal evidence rules in China. The second part analyzes the current legislative situation of the exclusionary rule of illegal evidence in our country, especially the two evidential regulations promulgated jointly by the five ministries and the newly revised Criminal procedure Law, aiming at the preliminary establishment of the exclusionary rule of illegal evidence in our country. This paper probes into the manifestation, characteristics and shortcomings in legislation and the practical difficulties in judicial practice of the rule of exclusion of illegal evidence in China at present price. The third part analyzes the relationship between the exclusion of illegal evidence and the examination of arrest, and finds out the practical problems faced by the investigation and supervision department in the stage of examination and arrest in the application of the rule of exclusion of illegal evidence. In the fourth part, the author puts forward some measures and suggestions to apply the exclusionary rule of illegal evidence in the stage of examination and arrest, and combines the practice of examining and arresting, aiming at the deficiency of the rule of exclusion of illegal evidence applied in the stage of examination and arrest of our country in the stage of examination and arrest. Some suggestions are put forward to establish the standard of proof, to perfect the starting procedure, to clear the exclusionary effect and to correct the evidence. This is the focus and difficulty of this paper.
