【摘要】：社會(huì)學(xué)法律解釋是法官在司法實(shí)踐中結(jié)合當(dāng)前當(dāng)?shù)厣鐣?huì)生活的實(shí)際情況和所審理的特定案件的特定事實(shí),依據(jù)但不拘泥于法律規(guī)范的文字表述和邏輯推演,通過對(duì)判決可能產(chǎn)生的社會(huì)影響或社會(huì)效果進(jìn)行預(yù)測(cè)或評(píng)估,作出預(yù)計(jì)能產(chǎn)生良好社會(huì)效果的法律解釋方法。社會(huì)學(xué)法律解釋方法強(qiáng)調(diào)各種社會(huì)利益的權(quán)衡以及社會(huì)利益衡量標(biāo)準(zhǔn)的客觀性,強(qiáng)調(diào)法律的變動(dòng)性和適應(yīng)性。社會(huì)學(xué)法律解釋方法有利于維護(hù)法律的安定性和一致性,同時(shí)又使法律能適應(yīng)社會(huì)生活的變化。法官在司法實(shí)踐中運(yùn)用社會(huì)學(xué)法律解釋方法有利于實(shí)現(xiàn)法律效果和社會(huì)效果的統(tǒng)一。
[Abstract]:The sociological legal interpretation is that the judge combines the actual situation of the current local social life and the specific facts of the particular case in the judicial practice, based on but not bound to the legal norms of the text expression and logical deduction. Through the prediction or evaluation of the possible social impact or social effect of the judgment, a method of legal interpretation which can be expected to produce good social effects is made. The method of sociological legal interpretation emphasizes the balance of various social interests and the objectivity of the measure standard of social interest, and emphasizes the variability and adaptability of the law. The method of sociological legal interpretation helps to maintain the stability and consistency of the law, and at the same time to adapt the law to the changes of social life. The application of sociological legal interpretation in judicial practice is beneficial to the unification of legal effect and social effect.
