【摘要】：技術(shù)偵查作為一種新型偵查手段,因其效率高、專業(yè)化程度強在我國司法實踐中得以普遍適用,2012年新修訂的《中華人民共和國刑事訴訟法》(以下簡稱《刑事訴訟法》)對技術(shù)偵查措施進行了規(guī)定,以規(guī)范了偵查人員的技術(shù)偵查行為。然而司法實務中偵查人員濫用技術(shù)偵查措施的現(xiàn)象時有發(fā)生,既不利于發(fā)揮其應有的作用,也會侵犯被追訴人的權(quán)利�；诖�,本文擬對我國技術(shù)偵查的基本問題進行介紹,闡述其運行現(xiàn)狀并揭示其中不足之處,通過借鑒英美法系和大陸法系國家關(guān)于技術(shù)偵查的成功經(jīng)驗,提出完善我國技術(shù)偵查法律規(guī)制的具體措施,更好的構(gòu)建我國關(guān)于技術(shù)偵查的法律制度。全文主要分為五部分,第一部分是全文的引言部分,介紹文章的研究背景及其意義,研究方法以及文章的框架。第二部分介紹了技術(shù)偵查的基本概念以及技術(shù)偵查法律規(guī)制的概念,通過人權(quán)保障、程序法定、權(quán)力制約三個原則闡述對技術(shù)偵查進行法律規(guī)制的理論依據(jù)。第三部分闡述了我國技術(shù)偵查的立法現(xiàn)狀,從適用范圍不明確、批準主體不合理、執(zhí)行程序不規(guī)范以及缺乏有效的權(quán)利救濟機制四個方面分析技術(shù)偵查立法情況的不足之處。第四部分介紹了英美法系、大陸法系主要法治國家技術(shù)偵查的立法現(xiàn)狀,通過總結(jié)比較主要法治國家的立法情況,得出更好的構(gòu)建技術(shù)偵查法律規(guī)制的相關(guān)啟示。第五部分闡述完善技術(shù)偵查法律規(guī)制的途徑,針對第三部分提出的不足之處,從適用范圍、批準主體、執(zhí)行程序、相關(guān)權(quán)利救濟機制四個方面來完善我國技術(shù)偵查法律規(guī)制,確保偵查環(huán)節(jié)的有效進行。
[Abstract]:As a new investigative technique, technical investigation has high efficiency. The strong degree of specialization can be widely applied in the judicial practice of our country. The newly revised Criminal procedure Law of the people's Republic of China (hereinafter referred to as "Criminal procedure Law") provides for technical investigation measures in 2012. In order to standardize the technical investigation behavior of investigators. However, the phenomenon of investigators abusing technical investigative measures in judicial practice occurs from time to time, which is not conducive to the exertion of their due role, but also infringes on the rights of the accused. Based on this, this paper will introduce the basic problems of technical investigation in our country, expound the current situation of its operation and reveal its inadequacies, and learn from the successful experience of the countries of Anglo-American law system and civil law system on the technical investigation. This paper puts forward some concrete measures to perfect the legal regulation of technical investigation in our country and better construct the legal system of technical investigation in our country. The paper is divided into five parts. The first part is the introduction of the article, introducing the research background and significance, research methods and the framework of the article. The second part introduces the basic concept of technical investigation and the concept of legal regulation of technical investigation, and expounds the theoretical basis of legal regulation of technical investigation through the three principles of human rights protection, procedural law and power restriction. The third part expounds the legislation status quo of technical investigation in our country. It analyzes the shortcomings of the legislative situation of technical investigation from four aspects: the scope of application is not clear, the subject of approval is unreasonable, the execution procedure is not standard, and there is a lack of effective right relief mechanism. The fourth part introduces the legislation status of technical investigation in Anglo-American law system and civil law system. By summarizing and comparing the legislative situation of the main countries ruled by law, the author draws the enlightenment of constructing the legal regulation of technical investigation. The fifth part elaborates the way to perfect the legal regulation of the technical investigation, aiming at the deficiency of the third part, from the application scope, the approval subject, the execution procedure, the related right relief mechanism to perfect our country technical investigation legal regulation.
