【摘要】：修訂后的《刑事訴訟法》在第121條規(guī)定:"偵查人員在訊問(wèn)犯罪嫌疑人的時(shí)候,可以對(duì)訊問(wèn)過(guò)程進(jìn)行錄音或者錄像,對(duì)于可能判處無(wú)期徒刑、死刑的案件或者其他重大犯罪案件,應(yīng)當(dāng)對(duì)訊問(wèn)過(guò)程進(jìn)行錄音或者錄像。"由此訊問(wèn)同步錄音錄像制度在我國(guó)確立。檢察機(jī)關(guān)、公安機(jī)關(guān)分別制定了本系統(tǒng)訊問(wèn)同步錄音錄像的實(shí)施細(xì)則,但這些制度因各方面的原因在實(shí)際中并未嚴(yán)格執(zhí)行,而且制度設(shè)計(jì)上還有諸多需要完善的地方,因此有必要在刑事司法改革的大環(huán)境下對(duì)訊問(wèn)同步錄音錄像制度進(jìn)行研究。本文立足于我國(guó)現(xiàn)有的訊問(wèn)同步錄音錄像制度,對(duì)其實(shí)際運(yùn)行狀況進(jìn)行了分析、研判,并在網(wǎng)絡(luò)技術(shù)和云存儲(chǔ)技術(shù)飛速發(fā)展的社會(huì)大背景下,探索適合當(dāng)前國(guó)情的訊問(wèn)同步錄音錄像制度設(shè)計(jì)和具體規(guī)定。本文共分為四個(gè)部分:第一部分探討訊問(wèn)同步錄音錄像制度確立的必要性,通過(guò)分析訊問(wèn)錄音錄像確立的原因,以及對(duì)犯罪嫌疑人、訊問(wèn)人、公訴人員、審判人員及辯護(hù)人等各刑事訴訟參與方的作用,確立訊問(wèn)錄音錄像的必要性。第二部分分析訊問(wèn)錄音錄像制度的立法演進(jìn),梳理了 2012年《刑事訴訟法》修訂前檢察機(jī)關(guān)、公安機(jī)關(guān)對(duì)訊問(wèn)錄音錄像制度的探索,以及《刑事訴訟法》正式確立該制度后檢察機(jī)關(guān)、公安機(jī)關(guān)陸續(xù)出臺(tái)的相關(guān)規(guī)定。第三部分分析訊問(wèn)錄音錄像制度落實(shí)中出現(xiàn)的主要問(wèn)題,如部分錄制規(guī)定不合理,全程錄制實(shí)現(xiàn)困難,保管制度不完善,錄制過(guò)程缺乏監(jiān)督,錄制效果不佳等。從法律層面、技術(shù)層面和人員經(jīng)費(fèi)三方面對(duì)產(chǎn)生上述問(wèn)題的原因進(jìn)行了分析。第四部分是完善我國(guó)訊問(wèn)錄音錄像制度的意見(jiàn)建議,主要是完善法律規(guī)定,提升訊問(wèn)同步錄音錄像的管理水平,運(yùn)用科技方法實(shí)現(xiàn)全面、全程、全部錄制。
[Abstract]:Article 121 of the revised Code of Criminal procedure stipulates: "when interrogating a criminal suspect, an investigator may make audio or video recordings of the interrogation process, and in cases that may be sentenced to life imprisonment, the death penalty or other serious crimes," The system of simultaneous audio and video recording of interrogation shall be established in China. The procuratorial organ and the public security organ have separately formulated the detailed rules for the implementation of the simultaneous audio and video recording of the interrogation in this system. However, these systems have not been strictly implemented in practice for various reasons, and there are still many areas that need to be improved in the design of the system. Therefore, it is necessary to study the synchronous audio and video recording system of interrogation under the circumstances of criminal judicial reform. And under the background of the rapid development of network technology and cloud storage technology, This paper is divided into four parts: the first part discusses the necessity of the establishment of interrogation synchronous audio and video recording system, and analyzes the reasons for the establishment of interrogation audio and video recording system. As well as the role of criminal suspects, interrogators, public prosecutors, judges and defenders, and so on, to establish the necessity of audiovisual recording of interrogation. The second part analyzes the legislative evolution of audiovisual recording system of interrogation. Combing the procuratorial organs before the revision of the Criminal procedure Law in 2012, the exploration of the audio and video recording system of interrogations by the public security organs, and the procuratorial organs after the formal establishment of the system in the Criminal procedure Law, The third part analyzes the main problems in the implementation of the audiovisual recording system for questioning, such as unreasonable recording regulations, difficulties in realizing the whole recording process, imperfect custody system, and lack of supervision over the recording process. The reasons for the above problems are analyzed from the legal level, the technical level and the personnel funds. The fourth part is the suggestions to perfect the audiovisual recording system of interrogation in our country, mainly to perfect the legal provisions. Improve the management level of simultaneous audio and video recording of interrogations, and use scientific and technological methods to achieve full, full and complete recording.
