【摘要】：正長期以來,受傳統(tǒng)落后執(zhí)法理念的影響,司法實(shí)踐中,往往偏頗理解傳統(tǒng)文化"中庸"、"和諧"的本意,檢察機(jī)關(guān)至今仍存在一些不善監(jiān)督、不愿監(jiān)督、不敢監(jiān)督的問題。對(duì)此,筆者以為,不妨從我國傳統(tǒng)文化的角度對(duì)現(xiàn)有訴訟監(jiān)督的理念、功能、制度和程序設(shè)計(jì)等方面進(jìn)行審視,挖掘提煉傳統(tǒng)文化中的精髓加以繼承發(fā)揚(yáng)。謹(jǐn)提兩個(gè)方面:一要培育法律文化,吸取精華,正本清源。將傳統(tǒng)文化培育作為法律文化建設(shè)的必要組成部分,使傳統(tǒng)文化精髓理念在訴訟工作理念中固化下來,改變傳統(tǒng)觀念。
[Abstract]:For a long time, under the influence of the traditional backward idea of law enforcement, in judicial practice, the intention of the "mean" and "harmony" of traditional culture is often biased. The procuratorial organs still have some poor supervision and do not want to supervise. The author thinks that from the perspective of our traditional culture, we can examine the concept, function, system and program design of the current litigation supervision. Dig and refine the essence of traditional culture and carry it forward. First, we should cultivate the legal culture, absorb the essence, and clear the root of the source. Take the cultivation of the traditional culture as an essential part of the construction of the legal culture. Make the essence of traditional culture in litigation work concept solidified down, change the traditional concept.
