【摘要】： 現(xiàn)代海上保險(xiǎn)作為一種舶來(lái)品,萌芽于地中海,成熟于英國(guó),是一種操作起來(lái)比較復(fù)雜且涉及法律問(wèn)題較為繁瑣的保險(xiǎn)險(xiǎn)種。而海上保險(xiǎn)單證作為海上保險(xiǎn)操作的外在表現(xiàn)形式和主要書(shū)面憑證,其交接和傳遞貫穿于海上保險(xiǎn)實(shí)務(wù)的全過(guò)程。對(duì)海上保險(xiǎn)單證不同類型、不同層次的區(qū)分,一來(lái)可以在理論上構(gòu)建海上保險(xiǎn)單證的概念框架,從而深化我們對(duì)海上保險(xiǎn)的認(rèn)知；二來(lái)可以在實(shí)務(wù)中完善海上保險(xiǎn)的投保承保、索賠理賠與追償技術(shù)；三來(lái)可以從法律規(guī)制角度,建立健全調(diào)整海上保險(xiǎn)單證的制度和法規(guī)。即對(duì)海上保險(xiǎn)單證的分類化研究,無(wú)論對(duì)豐富和完善海上保險(xiǎn)單證的基礎(chǔ)理論和實(shí)務(wù)操作技術(shù),還是對(duì)建立健全海上保險(xiǎn)單證的法律規(guī)制體系都有著不可替代的作用。但我國(guó)目前實(shí)務(wù)界與學(xué)術(shù)界對(duì)此問(wèn)題的解讀有所脫節(jié),對(duì)外貿(mào)易單證實(shí)務(wù)中多是從形式角度對(duì)此作出研究,而海上保險(xiǎn)法學(xué)界則多從內(nèi)容角度對(duì)其闡述,導(dǎo)致我國(guó)現(xiàn)行法律對(duì)海上保險(xiǎn)單證的規(guī)范并不完善,僅有《保險(xiǎn)法》和《海商法》中較為粗略的規(guī)定,致使實(shí)務(wù)中多發(fā)爭(zhēng)議卻缺乏法律解決依據(jù)。實(shí)際上,無(wú)論是從形式角度還是內(nèi)容角度對(duì)海上保險(xiǎn)單證作出的分類都具有其自身的價(jià)值和意義,不同類型的海上保險(xiǎn)單證的填制技巧和制度安排迥然相異。 本文在對(duì)海上保險(xiǎn)單證形式及內(nèi)容的分類的全面闡述中,解析了海上保險(xiǎn)單證因分類而產(chǎn)生的填制方法和繕制技巧的異同,結(jié)合實(shí)踐中出現(xiàn)的問(wèn)題和案例,并借鑒了英美海上保險(xiǎn)單證的相關(guān)成文法及權(quán)威判例,對(duì)海上保險(xiǎn)單證的法律規(guī)制作出了評(píng)述,進(jìn)而提出了我國(guó)海上保險(xiǎn)單證制度的完善建議。希冀以此對(duì)外貿(mào)單證實(shí)務(wù)提供一定的技術(shù)性支持,并為海上保險(xiǎn)法律規(guī)制提供一些理論參考。
[Abstract]:Modern marine insurance, as an imported product, sprouts in the Mediterranean Sea and matures in Britain. It is a kind of insurance with complicated operation and complicated legal problems. Marine insurance documents as the external form of marine insurance operation and the main written evidence, its transfer and transmission throughout the whole process of marine insurance practice. In order to deepen our cognition of marine insurance, we can construct the conceptual framework of marine insurance documents in theory by distinguishing different types and levels of marine insurance documents. Secondly, we can perfect the insurance underwriting, claim settlement and recovery technology of marine insurance in practice; thirdly, we can establish and perfect the system and regulation of adjusting marine insurance documents from the angle of legal regulation. That is to say, the classification of marine insurance documents plays an irreplaceable role in enriching and perfecting the basic theory and practical operation techniques of marine insurance documents, as well as in establishing and perfecting the legal regulation system of marine insurance documents. However, at present, the interpretation of this issue is out of line between the practical circles and the academic circles in our country. In the practice of foreign trade documents, most of them are studied from the angle of form, while the field of marine insurance law mainly expounds it from the point of view of content. As a result, the current law of our country is not perfect in the regulation of marine insurance documents, there are only rough provisions in the Insurance Law and Maritime Law, which leads to the frequent disputes in practice but lack of legal basis for solving them. In fact, the classification of marine insurance documents from the angle of form and content has its own value and significance. Different types of marine insurance documents have different filling skills and institutional arrangements. In the comprehensive description of the form and content of marine insurance documents, this paper analyzes the similarities and differences of the filling methods and preparation techniques of marine insurance documents arising from the classification, combining with the problems and cases arising from the practice. Based on the relevant statutory laws and authoritative jurisprudence of Anglo-American marine insurance documents, this paper makes a comment on the legal regulation of marine insurance documents, and then puts forward some suggestions for the perfection of the marine insurance documents system in China. It is hoped to provide some technical support for the practice of foreign trade documents and provide some theoretical references for the legal regulation of marine insurance.
