【摘要】：希伯來(lái)法是西方法律文明和英美法的源頭之一,具有很高的研究?jī)r(jià)值。希伯來(lái)的商業(yè)交易規(guī)范是以《圣經(jīng)》為法律淵源,源自習(xí)慣法則和宗教信仰,由此倡導(dǎo)契約守信觀念和誠(chéng)實(shí)無(wú)欺的貿(mào)易規(guī)則。從摩西時(shí)期的《圣經(jīng).舊約》到猶太教法典編纂時(shí)期的《塔木德》,商業(yè)交易規(guī)范形成與發(fā)展折射出希伯來(lái)商法的演變歷程,也從一個(gè)側(cè)面反映了西方商法成長(zhǎng)的最初概貌,因此對(duì)其做一細(xì)致的考證,在外國(guó)法律史研究上頗有補(bǔ)正的功效。
[Abstract]:Hebrew law is one of the sources of western legal civilization and Anglo-American law. The Hebrew norms of business transactions are based on the Bible, derived from customary laws and religious beliefs, which promote the concept of contract and trustworthiness and the trade rules of honesty and honesty. From the Bible of Moses. From Old Testament to Talmud during the period of Judaism codification, the formation and development of commercial transaction norms reflected the evolution of Hebrew commercial law, and also reflected the initial general picture of the growth of western commercial law from one side. Therefore, to do a careful textual research, in the study of foreign legal history quite has the effect of correction.
