【摘要】： 隨著船舶交易的興起,船舶所有權(quán)變動(dòng)日益頻繁,船舶所有權(quán)變動(dòng)的登記效力問(wèn)題也應(yīng)運(yùn)而生,并且逐漸成為理論界一直爭(zhēng)論不休的問(wèn)題。在登記對(duì)抗模式和登記生效模式的比較中,本文詳細(xì)闡述了二者的優(yōu)劣及相關(guān)制度的差異。并在對(duì)我國(guó)《物權(quán)法》和《海商法》中的登記效力進(jìn)行詳細(xì)分析基礎(chǔ)上,提出了相關(guān)的完善建議。本文共分四章來(lái)論述。 第一章為船舶所有權(quán)變動(dòng)登記效力的基本理論,包括船舶所有權(quán)變動(dòng)的含義,以及與船舶所有權(quán)登記的關(guān)聯(lián);船舶所有權(quán)登記效力的含義和影響船舶所有權(quán)變動(dòng)登記效力的要素。 第二章為我國(guó)船舶所有權(quán)變動(dòng)登記效力的立法分析。主要從兩方面論述,一是從我國(guó)《海商法》的相關(guān)規(guī)定,一是從我國(guó)《物權(quán)法》的相關(guān)規(guī)定。集中闡述了兩部法律的登記效力的適用范圍。 第三章為我國(guó)船舶所有權(quán)變動(dòng)登記效力的具體分析,包括船舶所有權(quán)變動(dòng)登記的公示效力,并且著重論述了船舶所有權(quán)變動(dòng)登記的公信力問(wèn)題。 第四章分析我了我國(guó)船舶所有權(quán)變動(dòng)登記效力的利弊,先從《物權(quán)法》和《海商法》的角度論述了我國(guó)的法律規(guī)定,然后在分析我國(guó)法律規(guī)定的基礎(chǔ)上提出了對(duì)我國(guó)法律完善的建議。
[Abstract]:With the rise of ship trading, ship ownership changes more and more frequently, and the registration effectiveness of ship ownership change has emerged, and has gradually become a controversial issue in the theoretical circle. In the comparison of registration confrontation mode and registration effective mode, this paper elaborates the advantages and disadvantages of the two models and the differences of relevant systems. On the basis of the detailed analysis of the registration effect in China's Real right Law and Maritime Law, some suggestions are put forward. This article is divided into four chapters to discuss. The first chapter is the basic theory of the effectiveness of ship ownership change registration, including the meaning of ship ownership change, and the relationship between ship ownership change and ship ownership registration. The meaning of the validity of ship ownership registration and the factors affecting the effectiveness of ship ownership change registration. The second chapter is the legislative analysis of the registration effect of ship ownership change in China. It is mainly discussed from two aspects, one is from the relevant provisions of China's Maritime Law, the other is from the relevant provisions of our country's property Law. The scope of application of the registration effect of the two laws is expounded. The third chapter is the specific analysis of the effectiveness of ship ownership change registration in China, including the public effectiveness of ship ownership change registration, and focuses on the credibility of ship ownership change registration. The fourth chapter analyzes the advantages and disadvantages of the registration of ship ownership changes in our country, and first discusses the legal provisions of our country from the angle of property Law and Maritime Law. Then, on the basis of analyzing the legal provisions of our country, the author puts forward some suggestions for the perfection of our law.
