【摘要】：由于我國經(jīng)濟(jì)的快速發(fā)展,我國城市的小商販數(shù)量急劇增加,他們給城市人的生活帶來了很大的便利,體現(xiàn)了城市低收入群體的生活需求,但是他們的存在也有一系列的問題。城管與小商販的緊張關(guān)系眾所周知,最主要的是小商販的營業(yè)權(quán)尚未得到解決,民事主體的營業(yè)權(quán)沒有得到法律上的肯認(rèn),使得小商販處在實際上的違法地位。在建設(shè)和諧社會的當(dāng)代中國,需要很好的處理好由于小商販的存在帶來的問題,小商販的基本權(quán)益得不到很好的保護(hù)極大的影響著社會的穩(wěn)定以及長遠(yuǎn)的發(fā)展,所以賦予小商販合法地位勢在必行。本文對小商販的一些基本情況以及目前存在的問題進(jìn)行了介紹,也強調(diào)了商法調(diào)整小商販有其必要性,明確本文探尋小商販立法之路的實用性,同時也分析了與小商販相類似的國外的“小商人”制度以及我國的個體工商戶制度,希望能在這兩個制度的相關(guān)規(guī)定中探尋出一條適合小商販的立法之路。通過對小商人制度的借鑒,摒棄個體工商戶制度存在的缺陷之處,最終提出了筆者的將小商販作為無名商主體之構(gòu)想。
[Abstract]:Due to the rapid development of economy in our country, the number of small traders in our city increases sharply, which brings great convenience to the life of the city people and reflects the living needs of the low-income groups in the city, but their existence also has a series of problems. The tense relationship between urban management and small vendors is well known, the most important thing is that the business rights of small vendors have not been resolved, and the business rights of civil subjects have not been recognized legally, which makes the small vendors in the illegal position in practice. In the construction of a harmonious society in contemporary China, it is necessary to deal well with the problems brought about by the existence of small traders, whose basic rights and interests are not well protected, which greatly affects social stability and long-term development. So it is imperative to give legal status to small traders. This paper introduces some basic situation of small vendors and the existing problems, also emphasizes the necessity of commercial law adjustment of small vendors, and clarifies the practicability of this article to explore the road of small vendors' legislation. At the same time, it also analyzes the "small merchant" system in foreign countries and the individual industrial and commercial household system in our country, hoping to find out a legislative road suitable for the small traders in the relevant provisions of these two systems. By drawing lessons from the system of small merchants, this paper abandons the defects of the system of individual businessmen, and finally puts forward my idea of taking small traders as the subject of anonymous merchants.
