【摘要】:海上貨物運(yùn)輸承運(yùn)人的責(zé)任問題是海上貨物運(yùn)輸法的核心,而其責(zé)任歸責(zé)原則 問題就更是核心中的核心。它反映船貨雙方的利益關(guān)系,制約或者促進(jìn)國(guó)際貿(mào)易和 海上運(yùn)輸業(yè)的發(fā)展,代表一個(gè)國(guó)家、地區(qū)甚至一個(gè)時(shí)代的主流思想和立法趨勢(shì)。當(dāng) 前,有關(guān)國(guó)際海上貨物運(yùn)輸?shù)姆珊懿唤y(tǒng)一,我國(guó)國(guó)內(nèi)的沿海貨物運(yùn)輸與國(guó)際海上 貨物運(yùn)輸法律制度也不一致。 本文分為五個(gè)部分。第一部分介紹和分析責(zé)任歸責(zé)原則的基本理論。在這部分里, 本文定義了國(guó)際海上貨物運(yùn)輸承運(yùn)人的歸責(zé)原則,分析了幾種歸責(zé)原則在海上貨物運(yùn) 輸領(lǐng)域的影響,并對(duì)海上貨物運(yùn)輸承運(yùn)人責(zé)任歸責(zé)原則的確定方法和評(píng)價(jià)標(biāo)準(zhǔn)做了初 步的探討。在第二部分中,本文對(duì)現(xiàn)行國(guó)際公約及法律對(duì)海上貨物運(yùn)輸承運(yùn)人責(zé)任歸 責(zé)原則的規(guī)定作出評(píng)價(jià)和分析。第三部分與第四部分對(duì)我國(guó)《海商法》和我國(guó)沿海貨 物運(yùn)輸法律中有關(guān)責(zé)任歸責(zé)原則的部分做出評(píng)價(jià),認(rèn)為目前在我國(guó)《海商法》中取消 不完全過錯(cuò)責(zé)任原則并不妥當(dāng)。第五部分對(duì)我國(guó)國(guó)際海上貨物運(yùn)輸與沿海貨物運(yùn)輸法 律制度的統(tǒng)一提出建議,認(rèn)為應(yīng)當(dāng)將國(guó)內(nèi)水路貨物運(yùn)輸納入《海商法》,均采取不完 全的過錯(cuò)責(zé)任原則,并且在適當(dāng)?shù)臅r(shí)機(jī)再修改為完全過錯(cuò)責(zé)任原則。 希望本文能夠?qū)ξ覈?guó)《海商法》中國(guó)際海上貨物運(yùn)輸承運(yùn)人責(zé)任部分的修改以及 完善我國(guó)沿海貨物運(yùn)輸承運(yùn)人責(zé)任問題提供理論參考,以便完善《海商法》對(duì)此問題 的相關(guān)規(guī)定,進(jìn)而達(dá)到統(tǒng)一立法及便利司法實(shí)踐的目的。
[Abstract]:The liability of the carrier in carriage of goods by sea is the core of the law of carriage of goods by sea, and the principle of liability fixation.
The problem is also the core of the core. It reflects the interests of both sides and restricts or promotes international trade.
The development of marine transportation represents the mainstream ideology and legislative trend of a country, region and even an era.
Before, the laws concerning international carriage of goods by sea are very different.
The legal system of freight transport is also inconsistent.
This article is divided into five parts. The first part introduces and analyzes the basic theory of liability imputation principle.
This article defines the principle of imputation of the international carriage of goods by sea, and analyzes several principles of liability fixation in the carriage of goods by sea.
The influence of the field of transportation and the determination method and evaluation standard of the liability principle of carrier's carriage responsibility were introduced.
In the second part, this article is responsible for the current international conventions and laws' liability for the carriage of goods by sea.
The third part and the fourth part of China's maritime law and China's coastal commodities.
In the law of transportation of goods, the part of the principle of liability fixation is evaluated, and it is considered to be abolished in China's maritime law.
The fifth part is about the law of international carriage of goods by sea and the law of the carriage of goods by sea.
The unification of the legal system suggests that domestic waterborne freight transport should be included in the maritime law.
The principle of fault liability should be amended and the principle of total fault liability should be amended at the right time.
It is hoped that this article will be able to amend the liability part of the international carriage of goods by sea in China's maritime law.
This paper provides a theoretical reference for improving the liability of carriers in China's coastal cargo transportation, so as to perfect the maritime law.
The relevant provisions, in order to achieve the purpose of unified legislation and facilitate judicial practice.
