【摘要】：在復(fù)審程序中,合議組審查范圍的界定是復(fù)審工作的難點(diǎn)之一。其中,對(duì)于案件中存在的復(fù)審請(qǐng)求范圍外的缺陷,合議組是否可依職權(quán)進(jìn)行審查也是日漸成為復(fù)審請(qǐng)求人與合議組,甚至法院的爭(zhēng)議焦點(diǎn)。本文通過(guò)對(duì)幾個(gè)案例的分析,希望能改進(jìn)對(duì)于是否可依職權(quán)審查明顯實(shí)質(zhì)性缺陷的考量方法。
[Abstract]:In the review procedure, the definition of the scope of the collegiate group review is one of the difficulties in the review work. Among them, for the defects outside the scope of the review request in the case, whether the collegiate group can examine it ex officio is also becoming the focus of controversy between the review petitioner and the collegiate group, and even the court. Through the analysis of several cases, this paper hopes to improve the method of considering whether the obvious substantial defects can be examined ex officio.
