【摘要】：在我國《民法總則》中,社會主義核心價值觀在總體上未處于民法基本原則的地位,因其在構成要件和法律效果方面均較模糊,因而不是獨立的裁判規(guī)范。但其為民法總則乃至民法典的目標、任務,不妨礙其中的平等、自由、公正、誠信等核心價值作為民法的基本原則。《民法總則》關于個人信息、數(shù)據(jù)、網(wǎng)絡虛擬財產(chǎn)的規(guī)定屬于指引性、"法源性"的條款,具有時代氣息、初步滿足實際生活的需要,引出制定具體規(guī)則的任務。承認宗教活動場所(組織)等團體的特別法人資格,將非法人組織作為第三民事主體,專設危難相助的特別制度,在特定情況下民政部門被首選為監(jiān)護人,等等,這些都立足于中國現(xiàn)實、關注并解決中國問題,具有里程碑式的意義,值得鼓與呼。

However, it is the goal and mission of the General provisions of Civil Law and even the Civil Code, without prejudice to the core values of equality, freedom, justice, integrity and other core values of the Civil Code as the basic principles of the Civil Law. About personal Information, data in the General principles of the Civil Code, The stipulation of the network virtual property belongs to the guidance, the "law source" clause, has the time breath, initially satisfies the actual life needs, leads to the task of making specific rules. Recognizing the special legal personality of groups such as places of religious activity (organizations), taking unincorporated organizations as the third civil subject, establishing a special system of assistance in distress, and selecting civil affairs departments as guardians under certain circumstances, and so on, All these are based on China's reality, pay attention to and solve the Chinese problem, with a landmark significance, worthy of drum and shout.
