【摘要】：共有物分割之訴是基于共有物分割請求權的裁判行使而產(chǎn)生的訴訟,其訴訟標的為具有形成權性質(zhì)的共有物分割請求權,具體包括請求分割共有物之訴與確定共有物分割方法之訴兩種表現(xiàn)形態(tài)。共有物分割之訴不屬于非訟事件,應定性為訴訟事件,且為形成之訴,而非給付之訴。
[Abstract]:The action of the division of common things is based on the judgment exercise of the claim for the division of common things, and the object of the action is the claim of division of the common property with the nature of forming right. It includes two forms: the action of requesting division of common things and the method of determining the division of common things. The action of division of common things is not a non-litigant event, it should be characterized as a litigation event, and it is a formative action, not a lawsuit for payment.
